So, I'm happy to report that the La Cumbre Water Company has now broken their silence on SB County's proposed new 14' wide road through the Modoc Preserve...
In a nutshell...any encroachment into the Preserve has to be run by the Land Trust of SB County...HALLELUJAH!!!
There was a meeting this morning between Land Trust of SB County, LCMWC, SB County Public Works, & Gregg Hart's office...
Alex Rodriguez, President of LCMWC, said :"Please note that what I reiterated on the call with the County is that the Water Company is the owner of the land, but that the Land Trust holds the Conservation Easement over the land and we defer to the Land Trust’s position, whether for the multi-use path or any other project on the land."
Meredith Hendrick's, Executive Director for Land Trust of SB County said :
"The County agreed to make surveying the legal description of the conservation easement a top priority so that we can all be crystal clear about whether any proposed bike path alignment would be within the preserve at any point. They understand this is a ‘threshold question’- if what they are planning to do is outside the legal bounds of the easement then the Land Trust is no longer party to the process.
If the proposed alignments cross into the legal boundary of the easement then the Land Trust would need the level of detail identified in our August 17th letter to make a determination of whether the project is allowable. We know they are not at the point in the process of being able to answer those questions because that is not the level of detail environmental review gets into however we will submit public comment reiterating our process if it is determined that the proposed alignment is within the easement.
I asked that the County better acknowledge the easement in their communications and sent Chris S a link to our website so that they can see we have linked to their information."
Let's hope that the survey doesn't go south...south into the Preserve...;-)
Nothing changes for us with our opposition approach...there are still at least 29 Canary Island Date palms, as well as some California Live Oaks, and Blue Gum Eucalyptus trees that are still threatened...especially, if SB County carries out their threat of implementing Alignment A or using eminent domain...etc...
