The Issue
In the heart of Sol Legare, James Island, SC, stands a majestic grand sand oak tree, a testament to the resilience and history of this beloved community. This magnificent tree has witnessed over 200 years of growth and change--generations of children and families, standing tall with a 40-inch diameter at breast height (DBH). It is not just a tree; it is a living monument to the unique heritage and cultural landscape of Sol Legare.
This cherished historical landmark is now under threat. An applicant has approached the Charleston County Board of Zoning Appeals requesting a variance to remove the grand sand oak. This developer wishes to subdivide historic lots in the area to build "spec houses" for sale; and is requesting to remove this unique healthy grand sand oak. This tree's loss would not only affect the natural beauty of this area and all of Sol Legare, but also diminish a crucial link to the historic community's past. The County's BZA is scheduled to hear this case in April 2026.
We are urging the local authorities and developers to recognize the cultural and environmental significance of this Historic Grand Sand Oak.
We are asking specifically for the Charleston County Board of Zoning Appeals (the BZA) to DENY the applicant's request for a variance to remove the Historic Grand Sand Oak.

1. Designating the tree as a protected historical landmark - ensuring it remains legally protected against any form of destruction.
2. Creating a buffer zone surrounding the tree, preventing construction activities that could harm its roots and structural integrity.
3. Incorporating the tree into any sensible future development plans as a centerpiece for a community pocket park or green space, allowing it to be celebrated rather than threatened. It may be possible to utilize Charleston County Greenbelt funds to do so.
