The Karnataka High Court Order dated 08-02-2018 in W.P.No.38797/2017, clearly states a commitment by the BBMP, that it would not form the Road, unless it has consent from the petitioner and all parties.
In a blatant contempt of court, the BBMP commenced Road formation on the 6th of Oct 2021. The development was reported on Front Page in the Bangalore Mirror Dated 9th Oct 2021: https://bangaloremirror.indiatimes.com/bangalore/cover-story/zoned-out/articleshow/86879866.cms
Road formation work was suspended thereafter for a while, but resumed on 19th Oct 2021. The original petitioners have taken pictures of the Road Formation work and have filed for a hearing in the Hight Court. Likely to come up this week. Now the issue is sub-judice with the Chief Commissioner as respondent.
Does the BBMP Chief Commissioner feel he can commit Contempt Of Court & get away with it?
There are 3 severe violations in this road project:
1) Contempt of Court, for not sticking to commitment provided to the High Court, violative of order passed by HC in 2018.
2) Violation of Public Opinion. More than 1000 residents of the affected area, have submitted signed petition to the BBMP Commissioner, opposing this road project, in 2018 itself. https://www.change.org/p/bbmpadmn-bbmpcomm-cmofkarnataka-bsbommai-arvindlbjp-save-pattandur-agrahara-lake-from-land-sharks/u/29730955
3) No Permission for violating Lake Buffer Zone. BBMP has to apply to KTCDA for permission for construction on lake buffer zone. The KTCDA will not give permission for violation of lake buffer zones, for new projects. So the project is illegal. And the BBMP is trying to bluff its way.
STOP THIS ILLEGAL CONSTRUCTION RIGHT AWAY! ABIDE BY THE LAWS!
