Shareholders of property within these 55+ Adult Common Interest and Private Residential Retirement Communities have long relied upon homeowner associations (HOAs) to uphold by-laws that ensure the protection of our deed ownership and property rights.
Recently, NJ State Lawmakers have introduced several pieces of legislation A3466 and A2832 (S791) and that is threatening to disrupt the peaceful and secure environment we cherish. The state’s continuous desire to intervene in the homeowner association's operations of housing transfers and it's enforcement of Covenants and By-laws not only undermines the autonomous governance that has long been a hallmark of our communities, but also jeopardizes our rights as property owners. Our communities have been self-governing, adapting to our unique needs, and ensuring that individual property rights are respected through established local agreements.
Statistics from the New Jersey Housing Market Association show that 62% of residents in these 55+ communities chose their current living situation for the autonomy and security it provides. Yet, state policies are increasingly imposing regulations that could dismantle the infrastructure permitting this autonomy. The influence and decisions made by remote entities unfamiliar with the intimate dynamics of our communities could lead to irreversible changes in our governance structures.
It's crucial to recognize that these residential communities are not just collections of houses, but networks of interconnected lives, relying heavily on local governance to maintain harmony and accord. State interference threatens to unravel this fabric, leading to a loss of community identity and control over personal property affairs.
