So everyone knows what I have warned with... this is the ordinance of the Village of Romeoville and the highlighted parts they gave me that I may be offending. Then there are the nearly 25 year old HOA rules that I'm up against. I have a google map that has at least 3 child daycares and 10 home business that I can tell in my immediate area, I'm sure that's not all. One child day is in my subdivision.
Village of Romeoville Ordinance Violation
159.034G is the Ordinance - my offense is "Cozy Paws (sic) dog boarding and daycare is prohibited" in any residential districts, unless specifically permitted by the district regulations. The ones highlighted are:
- (1) Animal kennels or hospitals,
- (2) Boarding house, hotel, timeshare condominium,
- (3) Dog breeders or dog re-sellers
- (4) stables or animal care (veterinarian)
- (5)Veterinary uses (including care, grooming, or boarding).
- I really don't do any of the above as stated.
Then I was also given 22 pages called Chapter 90 Cats and dogs nothing highlighted but assuming 90.27 limitations of animals...A single family detached residence shall not contain, shelter, or house in any way more than a combined total of 5 dogs or cats....A single family detached residence shall not own, shelter or permit more than 10 4-legged domestic animals, inclusive of the dogs and cats otherwise permitted by the preceding sentence. Bring on the rabbits, ferrets and guinea pigs!!
HOA 1999 Rules (this is before 9/11, my children and Covid, it's a different world now)
Section 9.03. Use Limitations The Lots shall be used only for residential purposes, as a private residence, and no professional, business or commercial use shall be made of the same or any portion thereof, nor shall any Occupant's or Owner's use of a Lot endanger the health or disturb the reasonable
enjoyment of any other Owner or Occupant, except that professional and quasi-professional persons may use their Dwelling Unit as an ancillary or secondary facility to an office elsewhere. The foregoing restrictions as to Lots shall not, however, be construed in such manner as to prohibit a resident from:
(a)maintaining his personal professional library; (b) keeping his personal business or professional records or accounts; or (c) handling his personal business or professional telephone calls or correspondence. Such uses are expressly declared customarily incident to the principal residential use and not in violation of said restrictions. This Section 9.02 shall also not be deemed to prohibit an Owner from caring for no more than four (4) unrelated children at any time within such Owner's Dwelling Unit.
Section 9.09. Animals No animals, livestock or poultry of any kind shall be raised, bred, or kept on any Lot, except that dogs and cats (not to exceed a total of four (4) such pets) or other common household pets may be kept, provided that they are not kept, bred, or maintained for any commercial purposes.
