Safe Firearm Ownership Initiative (SFOI)
The Issue
Purpose
This policy establishes a comprehensive framework for the ownership, training, and use of firearms in alignment with the Second Amendment rights of U.S. citizens. It aims to promote responsible gun ownership, enhance public safety, and prevent mass shootings through psychological and moral awareness initiatives, thorough evaluations, and training programs.
1. Eligibility for Firearm Ownership
1.1 Psychological Evaluations
Objective: To ensure that individuals seeking to own firearms are mentally stable and responsible.
- Evaluation Process:
- All applicants must undergo a thorough psychological evaluation by licensed mental health professionals before receiving a firearm eligibility certification aka weapon license.
- Evaluations will assess mental health history, emotional stability, moral reasoning, and potential risks associated with firearm ownership.
- Psychological Stability Assessment:
- Evaluators will examine:
- History of mental illness or substance abuse
- Emotional resilience and coping mechanisms
- Any history of violent behavior, criminal activity, or self-harm
- Ability to make sound moral decisions under stress
- Overall psychological stability to handle firearms responsibly
- The evaluator will issue a detailed report outlining findings and recommendations regarding the applicant’s eligibility. These findings may be shared ONLY with the individual and medical providers to stay in compliance with HIPAA Law.
1.2 Firearm Types
Objective: To allow a wide range of firearms and accesories to responsible citizens while maintaining safety protocols.
- Permitted Firearms Include, but are not limited to:
- Standard handguns and rifles
- Short-Barreled Rifles (SBRs)
- Short-Barreled Shotguns (SBSs)
- Fully automatic firearms (machine guns)
- There are no restrictions on firearms accesories
- Registration Requirements:
- All firearms must be registered with appropriate authorities, including a unique identifier for each firearm and owner details. This does not include firearms that have been built or manufactured by an individual for personal use.
1.3 Background Checks and Additional Evaluations
Objective: To ensure thorough vetting of all firearm purchasers.
- Background Checks:
- Mandatory background checks for all firearm purchases, including checks for criminal history, mental health records, and any previous firearm-related incidents.
- Additional Psychological Evaluations:
- A brief psychological evaluation will be required for each eligible purchaser at the time of purchase. This evaluation will confirm the buyers continued eligibility for ownership based on their mental state at the time of purchase. If an eligible person purchases multiple firearms at once, only one brief psychological evaluation will be needed for that transaction.
- Validity Period: The results of the psychological evaluation will remain valid for up to 30 days from the date of the evaluation, allowing for multiple purchases within that timeframe without the need for additional evaluations. The validity period ONLY affects purchases.
- In private firearm sales, A new psychological evaluation is not needed. The buyer is only required to provide the seller with their valid firearm psychological evaluation certification or firearm license, along with a valid photo ID.
1.4 Eligibility for Individuals with Criminal Convictions
Objective: To allow responsible reintegration of individuals with criminal backgrounds into society.
- Eligibility Criteria:
- Individuals convicted of crimes may participate in Second Amendment rights upon successful completion of:
- Psychological evaluations
- Moral aptitude assessments
- Evaluations necessary for release from incarceration
- Involvement of Law Professionals:
- Determination of eligibility for firearm ownership among previously convicted individuals will involve law professionals, with law enforcement only intervening in specific cases where public safety is a concern.
1.5 eligibility and compliance for previous gun owners and licensees:
- Facilitate easy integration of psychological evaluation compliance for previous gun owners and firearm license holders by providing grants for free evaluations.
2. Machine Gun Training and Acquisition
2.1 Training Application
Objective: To ensure proper training and skills for machine gun owners.
- Training Program Structure:
- Training programs must be certified and developed by professionals with law enforcement or military experience. Courses will cover:
- Safe handling and operation of machine guns
- Understanding mechanics and maintenance of the firearm
- Legal responsibilities and implications of owning a fully automatic firearm
- Ethical considerations regarding the use of firearms in self-defense situations
- CPR and other emergency lifesaving tactics that could be needed to treat GSWs (Gunshot Wounds) in a defense situation.
2.2 Training Completion Requirement
Objective: To verify proficiency and responsible use of machine guns.
- Certification Process:
- Upon successful completion of the training program, individuals will receive a certification stored in a government database for verification purposes.
- This certification will be accessible if the licensed individual loses their physical copy, ensuring that their qualifications are always verifiable.
- Recertification Requirements:
- Recertification for machine gun licensing may not be necessary unless specific circumstances arise that warrant reevaluation for the public's and licensee's safety. These circumstances may include any information brought to the attention of mental health professionals or law enforcement that suggests the certified user is no longer capable of responsibly operating the machine gun.
- However, licensure and identifications for General firearm licensing will require regular renewals. This ensures that photo IDs remain current.
3. Financial Initiatives for Ammunition
3.1 Cost-Friendly Ammunition Access
Objective: To promote regular training and enhance safety among firearm owners.
- Subsidy Programs:
- The government will implement subsidy programs to lower the cost of ammunition for eligible gun owners, particularly for training purposes.
- Partnerships with Manufacturers:
- Collaborations with ammunition manufacturers to provide discounts or bulk purchase options will be sought.
- Tax Insentives:
The government will offer tax incentives and support the maintenance and operation of gun ranges. Furthermore, compliance will provide additional incentives.
3.2 Impact on Safety
Objective: To reduce accidental discharges and enhance marksmanship skills while minimizing dangerous mishaps in public self-defense situations.
- Regular Training Opportunities:
- By making ammunition more affordable, eligible gun owners will be encouraged to practice regularly, which will improve their marksmanship and increase their familiarity with their firearms.
- Safety Monitoring:
- The policy will include mechanisms to track firearm-related accidents and incidents to assess the effectiveness of training and ammunition initiatives.
4. Accountability and Reporting
4.1 Revocation and Reapplication.
Objective: To ensure adherence to safety protocols and responsible ownership.
- Reapplication:
- Firearm owners who have had their rights revoked can regain them by demonstrating continued and improved moral, ethical, and psychological aptitude.
4.2 Reporting Mechanism
Objective: To foster a culture of accountability within the firearm ownership community.
- Anonymous Reporting Options:
- A reporting mechanism will be established for firearm owners to anonymously report concerns about their own or others' mental health and safety regarding firearm ownership.
- Additionally, When a report is submitted, a letter will be sent to the gun owner. A specialist, accompanied by a law enforcement officer, will conduct a check-in on the gun owner and perform a brief re-evaluation at no cost to the gun owner. [If the gun owner is unable to perform the evaluation at that time then they can schedule for another time on the letter that has been mailed. A direct refusal may result in a temporary confiscation of firearms.] If the gun owner passes the evaluation, no further action will be taken. However, if they fail, their firearms will be revoked until they successfully complete the psychological evaluation.
- The 4th Amendment shall NOT be infringed.
- Community Engagement:
- Educational programs will be implemented to raise awareness about responsible gun ownership and the available reporting mechanisms.
4.3 Mental Facility Admissions
- Admission Into Mental Facility By Firearm Owner:
- If a citizen is admitted to a mental health facility, the intake personnel are required to notify the citizen's local law enforcement agency. This notification will enable law enforcement to take necessary actions regarding the citizen's firearms until they are discharged from the facility with a certification of eligibility for firearm ownership.
- Upon discharge, the citizen must present this certification to the police department in order to retrieve their firearms on the same day. The certification will not contain any specific medical information; it will solely confirm the citizen's eligibility to own firearms. Additionally, follow-up evaluations will be required biweekly to assess the citizen's ongoing eligibility for lawful firearm possession. This evaluation process may extend from three months to one year, depending on individual circumstances. The citizen is responsible for submitting these evaluations to the police department, either in person or via fax, as directed by their mental health professional.
5. Privacy and Safety of Gun Owners
Objective: To protect the privacy and safety of responsible gun owners.
- Confidentiality of Registration Information:
- Licensing registration information will not be public record and will be kept confidential, ensuring that personal data and ownership details remain private and secure.
Conclusion
This detailed policy aims to uphold the rights granted by the Second Amendment while implementing necessary safeguards to ensure public safety and responsible gun ownership. By prioritizing psychological and moral awareness, comprehensive training, and accessible resources, we can create a safer environment for all citizens, ultimately reducing the risks associated with firearm ownership and enhancing the overall safety of our communities.
