The Issue
According to the state of Illinois a reinstatement for a driving permit for an individual who has 2 or more DUIs requires a 5 year permit with restricted driving privileges. Here is the brake down
Reinstatement BAIID
Statutory Summary Suspension
Driving privileges may be reinstated at the end of the statutory summary suspension period unless the court instructs the Secretary of State's office otherwise. Before driving privileges can be reinstated:
Other suspensions or revocations on the driving record must be closed.
A $250 reinstatement fee must be paid to the Secretary of State, $30 of which goes to the Department of Human Services, Office of Alcoholism and Substance Abuse, to help defray the cost of professional alcohol/drug evaluations for indigent offenders.
If a repeat offender, a $500 reinstatement fee must be paid to the Secretary of State, which $60 of which goes to the Illinois Road fund, $190 to the Drunk and Drugged Driving Prevention Fund, and $250 to the General Revenue Fund.
Reinstatement of a statutory summary suspension becomes valid when it is entered on the driver's record in the Secretary of State's office provided the provisional termination date has passed.
PETITION FOR AMENDMENT OF DUI LAW
WHEREAS, it is recognized that individuals who have not had a DUI offense in over 10 years and no longer consume alcohol may still need to drive in emergencies, for child visits, and unexpected events;
WHEREAS, it is acknowledged that individuals who have successfully completed a period of restriction involving the installation of a BAIID device and a restricted permit for at least 2 years without any alcohol violations have demonstrated responsible behavior;
WHEREAS, it is proposed that the current DUI law be amended to allow individuals meeting the above criteria to have their driving privileges fully reinstated while still keeping the BAIID device in their vehicle for the remaining duration of the 5-year program period;
BE IT RESOLVED that the undersigned petition for a change in the law to allow individuals who have demonstrated compliance with the BAIID program and have not had any alcohol violations during the initial 2 years of restriction to have their driving privileges fully reinstated.
BE IT FURTHER RESOLVED that the petitioners request that these individuals continue to bear the costs and fees associated with the BAIID program for the remaining years of the 5-year period, while being allowed to drive without restrictions.
