Right to travel freely without drivers license
The Issue
Petition to Protect the Constitutional Right to Travel and Private Property Rights
Petition to the United States Congress, State Legislatures, and the American People
We, the undersigned, petition for the protection and restoration of the constitutional right to travel freely, the protection of private property rights, and limits on government overreach regarding non-commercial transportation.
The Constitution was created to protect the liberties of the people—not to convert every peaceful activity into a regulated privilege.
Millions of Americans believe modern transportation laws have expanded far beyond their original commercial and public safety purposes and now improperly interfere with ordinary citizens traveling privately and peacefully.
Constitutional Foundation
The United States Constitution recognizes fundamental liberties that existed before government itself.
These rights are reflected throughout:
The United States Constitution
The United States Bill of Rights
The Ninth Amendment
The Fourteenth Amendment
Longstanding court recognition of interstate travel rights
The right to move freely between states and travel peacefully has historically been recognized as a fundamental liberty interest.
Commercial Driving vs. Private Travel
Commercial transportation and private travel are not identical activities.
Commercial Driving
Commercial drivers:
Operate for profit or business purposes
Transport goods or passengers commercially
Use public roadways as part of regulated commerce
Are subject to commercial licensing, insurance, and safety regulations
Examples include:
Semi-truck operators
Taxi services
Delivery fleets
Bus operators
Commercial freight carriers
Government regulation of commercial activity has long been tied to interstate commerce authority.
Private Non-Commercial Travel
Private citizens traveling for personal reasons are not engaged in commercial enterprise merely because they use an automobile.
Examples include:
Traveling to visit family
Going to work
Grocery shopping
Personal recreation
Religious travel
Medical appointments
Many Americans believe peaceful non-commercial movement should not be treated the same as commercial transportation activity.
Concerns About Government Overreach
We believe many modern transportation enforcement systems have expanded beyond legitimate safety concerns and now create:
Excessive fines and fees
Revenue-driven enforcement
Suspensions before full hearings
Vehicle seizures and impoundments
Criminalization of peaceful travel
Financial barriers affecting the poor disproportionately
Many citizens believe “public safety” is sometimes used as a blanket justification for excessive control, surveillance, penalties, and restrictions unrelated to actual reckless or dangerous conduct.
Public Safety Should Target Harmful Conduct
We support laws addressing:
Reckless driving
DUI offenses
Dangerous speeding
Actual harm to persons or property
However, we oppose systems that treat every peaceful traveler as a criminal or revenue source absent actual danger or injury.
Rights should not disappear simply because a person uses modern transportation.
We Demand Action
We call upon lawmakers and courts to:
Reaffirm the constitutional right to peaceful travel
Distinguish clearly between commercial transportation and private non-commercial travel
Protect private property rights involving personally owned vehicles
Prevent excessive fines, seizures, and revenue-driven enforcement practices
Ensure due process protections before suspensions or property deprivation
Limit government overreach under vague “public safety” claims where no actual harm exists
Constitutional Principles Matter
The Constitution was designed to limit government power and preserve liberty.
A free people should not lose fundamental rights through expanding regulations, administrative penalties, or financial barriers that disproportionately burden ordinary Americans.
The people retain rights not specifically surrendered to government.
