Update: UK - HMCTS Investigation Team Responded - Court-Held Funds

The funds in question are being held by the court. The Barrister has notified the courts with the relevant information.

The Cheshire police had stated that we need to seek a court order to obtain the post-mortem images that the coroner stated would be police exhibit.

The application presented with evidence would allow for the independent review of medical records, including any and all post-mortem images for the body registered as my brother.

To date, those funds have not been released/applied, for what I can only describe as inconsistent reasons. Without those funds being applied, we cannot secure a court date for the disclosure application.

Latest Development:

On *25th August 2026*, the *HMCTS Investigations Team reached out to me regarding a formal investigation into the funds held by the court.

We have responded to the Investigations Team in full, and we are now awaiting a response, which we hope to receive by 16th September 2026.

Why This Matters:

My concern is simple: If the courts are allowed to retain money that is intended to pay for a court application, without clear and consistent reason, then what is to stop this from happening again — to us, or to anyone else?

How can a family get a court date if the fee is being delayed?
