Revoke form 5 that is required to fill annually by Irish citizens through naturalisation
The Issue
Under the Irish Nationality and Citizenship Act 1956 as amended, the Minister for Justice has the power to revoke a certificate of naturalisation where an individual has been ordinarily resident outside of the State for seven years after naturalisation, unless;
They have registered annually in the prescribed manner their name and a declaration of an intention to retain Irish citizenship .This declaration is prescribed as form 5 .
Now, This law has an issue with discrimination against citizens through naturalisation and add unnecessary difficulties for Irish citizens who may need to live abroad.
It's also ambiguous how process works especially Ireland has no system to track citizens living abroad and whether they have lived 7 years or not and its difficult for many to know whether they wanted to live less or more than that in advance as circumstances may change anytime.
With ambiguity and vague process, it's unclear how you will be notified a decision of revoking your citizenship certificates while you live abroad and time and process to appeal against . Its difficult to appeal it abroad and at same time difficult to go back to appeal in Ireland within time given to you and on your own time and expenses, and how you will gather documents to support periods that were relying on changing circumstances. It's time, expenses, reporting every year thar you have to deal with it and at same time you may not notified on decision via proper channel .
This ultimate power given to minister has brought less value of Irish citizenship through naturalisation by imposing such restrictions or requirement as these restrictions/requirements means that they're not equal to other Irish citizens who didn't acquired citizenship through naturalisation .
The Other citizens may possibly born outside Ireland and may live freely outside Ireland too but may not asked to fill form 5 .
Therefore this law discriminate only against all those who received citizenship certificates through minister including children born in Ireland (who were not eligible for automatic citizenship at their birth) .
In summary, It's against citizens equity, and their own decision making on where to live .
Thus, we all calling for this form 5 to be revoked .
