Revisit the Age of Consent to Protect Vulnerable Teens From Predatory Adults
The Issue
As a deeply concerned parent, I am compelled to share a harrowing experience involving a 17-year-old close to my family. He became embroiled in a relationship with a manipulative, married, 38-year-old attorney who knew he could exploit the current age of consent laws to escape legal accountability. This older man wielded money, gifts, and threatened self-harm as tools to coerce this emotionally vulnerable child to maintain a relationship that gravely impacted his well-being.
The current age of consent law assumes a level of emotional maturity that not every adolescent possesses. The stark age disparity and power dynamic in this child's relationship starkly illustrates the flaws in our legal system, highlighting how these laws can enable predatory behavior at the expense of our young ones' well-being.
The way the current laws in Massachusetts is written an 18 year old that has sex (any form of penetration) with his 15 year old girlfriend he can be charged with Child Rape. But a 38 year old who has sex with a 17 year old is not in violation of the law, and a parent has very little options to protect their child. This is absurd, and needs to be revisited. Because we all understand that the teenagers are much closer in emotional maturity than a 17 and 38 year old could ever be.
These laws protect abusers. There are many instances of other trusted persons such as predatory teachers and clergy members that use the age of 16 as a threshold to target their victims knowing that they cannot face criminal prosecution.
It is high time that our legal system acknowledge and adapt to the complex realities of adolescent development. There is a crucial need to protect our teenagers from manipulation and exploitation by those who take advantage of the current age of consent regulations.
We have laws in place to protect our children from the the negative effects of consuming alcohol, cannabis, and nicotine. As well as safeguards for younger drivers. Gambling is age restricted and our children cannot withdraw from school, join the military or consent for most medical care without a parent's approval depending on age.
We appeal for the amendment of the age of consent law. Our children's welfare and mental health are paramount, and we must take the steps necessary to ensure their protection. Therefore, we urge lawmakers to review and raise the age of consent to 21, and add provisions for consent of those ages 16-20, to better safeguard vulnerable young people from predatory relationships.
