The Issue
My name is Derrick Smith, and I am writing this petition from within the walls of a prison where I have spent the last 15 years of my life. In 2011, when I was just 19, I made a mistake. I pled guilty to attempted assault on a police officer. For this, I received a 25-year sentence, predominantly for possessing a firearm during a felony. However, the circumstances surrounding my case and the subsequent revelations about the officer involved bring to light the profound injustice of my sentence.
The arresting officer, who played a pivotal role in my conviction, was later dismissed from the force after it was revealed that he had a history of framing innocent people. Despite this revelation, my sentence has remained unchanged. Even Justice Holland and Judge Ableman, both reputable figures within the justice system, have acknowledged the unfairness of the punishment I received. It's a punishment that starkly exceeds what others in similar situations have faced.
Statistics show that average sentences for firearm possession during similar circumstances are considerably lower, often not exceeding a decade. Yet, I've already served 15 long years, with 10 more to go if no intervention occurs. Each day is a reminder of the disparity and disproportion I face because of this sentence.
I am not asking for absolution. I am asking for justice. It's time for my sentence to be reviewed and considered with fairness, dignity, and the same consistent measure of justice we hope to see in our legal system.
