Serving the unethical business owners and self-suited politicians as a means of job security is the priority of OSDH leadership. LaTrina has been pushing employees to ignore the law and lower the standards which have led to experts leave. Separating the intertwined requirements of the State and Federal without considering the consequences have been openly pursued. Avoiding the laws and lowering the Oklahoma’s standards is against the mission statement of the OSDH and any promised quality assurance. Let’s have an overview of the Supremacy Clause Constitution and hierarchy of laws and regulation in the United States as a means to protect citizens against unscrupulous politicians, business owners and clinicians.

The core message of the Supremacy Clause is that the Constitution and federal laws take priority over any conflicting rules of State law. The Centers for Medicare & Medicaid Services, CMS, is a federal organization and part of the Department of Health and Human Services (HHS). “CMS serves the public as a trusted partner and steward, dedicated to advancing health equity, expanding coverage, and improving health outcomes.” For any business that bills CMS, CMS requirements are the minimum standards and take priority over any State requirements. 

The Oklahoma CMS liaison and Deputy Commissioner of Quality Assurance, LaTrina, with the support of Chief General Counsel have been pushing the OSDH employees to ignore the CMS requirements. Oklahomans deserve the Nation equal health standards set by CMS. Businesses must be accountable to provide services with the basic equal health standards. LaTrina’s actions deny the quality standards for Oklahomans and mislead the facility owners which open them to liabilities. Not giving the direct and hard answer to politician and business owners just lengthens the process which causes a loss of revenue for businesses and loss of proper standards of health care for Oklahomans.
