The Issue

A Knox County woman holds a U.S. passport and an amended Illinois birth certificate that both list her as female. Her Tennessee driver’s license does not, and the state refuses to change it. Every time she shows that license to a cashier, landlord, employer or police officer, she is outed as transgender, whether she wants to be or not. Now she is suing the state.

For years, Tennessee offered a clear path to update the sex marker on a license with medical documentation. That changed after Gov. Bill Lee signed a 2023 law defining sex by a person’s anatomy and genetics at birth. The Tennessee Department of Safety and Homeland Security then adopted a policy that blocks transgender residents from making the change at all.

The result is a system where one person can carry two government IDs that contradict each other. That kind of mismatch can cause confusion and suspicion at banks, job interviews and traffic stops. According to the lawsuit, being forced to reveal her transgender status this way exposes her to discrimination, harassment and violence.

The case also raises a basic constitutional question. The Full Faith and Credit Clause of the U.S. Constitution requires states to respect the official records of other states. The lawsuit argues that Tennessee is ignoring a legal birth certificate issued by Illinois, and that the policy violates the 14th Amendment’s promises of due process and equal protection.

No one should have to share private medical history just to rent an apartment or pick up a prescription. Governor Lee and Safety and Homeland Security Commissioner Jeff Long have the power to fix this by restoring a fair process for updating sex markers on Tennessee driver’s licenses.

Sign the petition to tell Governor Lee and Commissioner Long to let transgender Tennesseans carry IDs that match who they are, before anyone else is put at risk.
