UPDATE - CITY CODE DIRECTOR JIM YOUNG AND CITY OF KEY WEST REFUSE TO ENFORCE CODE VIOLATION ON N. ROOSEVELT BLVD. AGAINST LONG-TIME REPEATED VIOLATORS, BUT STRATEGICALLY AND REPEATEDLY GO AFTER DINGHY BEACH PROTESTER FOR POSTING IN SAME LOCATION

 

Summer 2021, City Code Troy Montero goes on-site to N. Roosevelt Blvd. where #RestoreDinghyBeach protestor Christine Lininger is holding up signs and has two (2) signs lightly attached to each other (not the tree) with bungee cord around one (1) palm tree on the sidewalk directly in front of Dinghy Beach. Montero states the location is under jurisdiction of the City and the City Manager's office and the posters may not be permanently attached/fixed or damage the palm trees. It is to be noted here that Mr. Montero also was the City Official who directly investigated Ms. Lininger's complaint to Code that Spottswood Companies had illegal annexed the public beach, had placed an unpermitted fence on the property as well and the filed paperwork to later have Spottswood Companies fined for the violation and he left the dept. before this issue was settled.

 

Autumn 2021, when asked by Ms. Lininger about requirements for #RestoreDinghyBeach protest posters being held up by hand or otherwise on near Dinghy Beach on N. Roosevelt Blvd., City Manager McLaughlin's office, citing City Ordinance 114-2, confirmed that any temporary posters/advertising/signs, etc. "could be used on N. Roosevelt Blvd. without a permit, but could not be fixed or attached to palm trees or utility poles without a written permission from the City Manager".

 

November 2021, for the fifth straight year, City Code (headed by Jim Young) allowed the Zonta Club, despite being in violation (again) of City Ordinance 114-2, to litter the palm trees of N. Roosevelt Blvd with orange bows and Zonta Club not having "written permission" from the City Manager, as the City required Ms. Lininger to do.

 

Dec. 27, 2021, KWPD is called by Marriott Beachside Manager David Talpasz complaining "female is protesting and putting signs on City property...is holding a sign saying Marriott has an illegal fence" and demanding she be stopped. KWPD officers go on-site to N. Roosevelt Blvd. where #RestoreDinghyBeach protestor Lininger is holding up signs and has two (2) signs attached to each other - not "to the tree" - with bungee cord around one (1) palm tree and one (1) utility pole on sidewalk directly in front of Dinghy Beach. 

KWPD Officers cite City Ordinance 114-2 as reason for requesting the immediate removal of the bungee-cord attached #RestoreDinghyBeach signs while Ms. Lininger was on-site protesting the Marriott Beachside/Spottswood Companies' illegal annexation of the public beach for the hour. KWPD told Ms. Lininger that the N. Roosevelt Blvd. property on which the signs were placed, was considered City property and she had to apply for a permit from the City before putting them up again.

Early February 2022, FDOT Head of Operations Dept., confirmed the property where the signs would go would be considered under the jurisdiction of the City and the City could authorize placement of the temporary signage, as had been done in the past "You would need to obtain permission from the local municipality for temporary placement of these banners/signs/posters".

Ms. Lininger followed up in the following days and contacted City Code and City Manager McLaughlin's office to apply for a permit to place #RestoreDinghyBeach posters/signs during her protest times for approx. 1-2hrs. up to 3-4x per week for the period during which the illegal annexation of Dinghy Beach by Spottswood and the City's research of property ownership was being debated and a date in the near future was to be set to discuss leasing the public land to Spottswood Companies.

Feb. 2022, City Manager McLaughlin denied the long-time #RestoreDinghyBeach protester permission to place ANY type of temporary signage on palm trees or utility poles in support of keeping the public beach public and against Spottswood 's continued illegal annexation of the precious recreational property.

Early 2022, City Manager McLaughlin refused to conduct a survey for the property to determine ownership rights on behalf of the City, despite being ordered to do so by the City Commission, and then attempted to hide that information from the Commission.

November 2022, City Manager McLaughlin and City Code's Director Jim Young did not enforce Ordinance 114-2 when Zonta Club littered N. Roosevelt Blvd. palm trees with their ribbons again.

November 2022, City Manager Patti McLaughlin and Asst. City Manager Todd Stoughton lied to the City Commission, distorted evidence the public waterfront property "Dinghy Beach" was a long-time public beach and allowed Spottswood Companies to continue his illegal annexation of the property in violation of Florida State law and against the City's directive by sponsoring his lease of the public beach. 

Kinda sounds like the City Manager's Office, with the help of then City Atty Smith, wasn't really working for the City, doesn't it?

 

Forward to November 2023 -

 

FDOT confirms their policy N. Roosevelt Blvd. "jurisdiction...belongs to local municipality" stated February 2022 still is in effect.

 

City of Key West Records confirms NO permit exists for Zonta Club's November 2023 ribbons placed on dozens of palm trees on N. Roosevelt Blvd. 

 

City Code and City Manager 's Office is informed of Zonta Club's ribbons Code 114-2 violation.

 

On November 21, 2023, City Code Director Jim Young refuses to enforce Code 114-2 stating "After reviewing your complaint and reviewing the City Ordinance, 114-2 which states “No notice, sign or any advertising matter shall be posted on any tree or telegraph or telephone pole erected on the city streets nor on the walls of any city building nor on any property of the city, without the written approval of the city manager. It appears the orange ribbons are tied to trees on FDOT owned sidewalks and are not on city streets or city property, therefore, there is no violation."

 

In this situation, it sure does look like City Code Director Jim Young only considers N. Roosevelt Blvd. to be the City's jurisdiction when it suits him (and Spottswood Companies agents) and the City Manager's Office and the City appear to only enforce Code when the entitled little Spottswood bitches whine about how wrong it is when someone calls them out on their illegal BS -  doesn't it?

But then considering how the City (& entitled clown buttkisser State Attorney Dennis Ward) continues to allow Spottswood Agents George Galvan, David Talpasz, Lane Wilder and Danny Galvan to get away with multiple felony and misdemeanor crimes against Ms. Lininger, I guess we really shouldn't expect anything different from this whole corrupt lot, now should we?

AN ATTACK AGAINST ONE #RESTOREDINGHYBEACH SUPPORTER IN AN ATTEMPT TO SILENCE THEM IS AN ATTACK AGAINST ALL.
