
We are NOT suing the City of Eagle Lake. We're not suing the developer either. This is a comment that has been said on social media a few times and it's simply not true.
As per MN Statute 116D.04 (Environmental Impact Statements) Subd 10. Review: A person aggrieved by a final decision on the need for an environmental assessment worksheet, the need for an environmental impact statement, or the adequacy of an environmental impact statement is entitled to judicial review of the decision under sections 14.63 to 14.68.
The information included in the Environmental Assessment Worksheet (EAW) does not determine if an EIS is needed, that is a decision made by the Responsible Government Unit (RGU) based on the information in the EAW and the submitted comments from the public and necessary agencies. In this case the RGU is the City of Eagle Lake.
So, we are not suing, we are asking for a judicial review on the decision to forgo an EIS. We believe the EAW was incomplete and many key concerns were not addressed before possibly approving this development.
We understand that some are reluctant to donate as they do not understand where the funds are going. All donations go into an account at United Prairie Bank under the CAMP name. From there they are paid to our lawyer (Marshall Tanick). The legal process can be complicated and we wanted it done correctly with representation we trusted to understand our position.
