Require proof of residency and visitation rights for child support
The Issue
For many parents in Maryland, the journey of parenthood is made even more challenging by the complexities of custody and child support. I am one of those parents. Despite my dutiful payment of child support, I face the heartbreaking reality of not being permitted to see my child. Additionally, the custodial parent, to whom I pay this support, no longer resides in the state of Maryland, yet continues to benefit from a court order issued here.
This situation is not just unfair, but also detrimental to the bond every child deserves to have with both parents. Maryland's current child support system does not adequately protect the rights of non-custodial parents, nor does it ensure that child support is used in the best interests of the child.
To rectify these issues, I propose that any custodial parent receiving child support should be mandated to present incontrovertible proof of residing within Maryland. Moreover, enforcing visitation rights should be inseparably linked with the enforcement of child support payments. Non-custodial parents should never be stripped of their right to be a part of their child's life solely because their responsibility to provide financial support can be enforced without ensuring they have access to their child.
Critically, requiring proof of residency would ensure a fair and transparent process, preventing misuse of court orders and ensuring that children maintain healthy relationships with both parents irrespective of their financial contributions. It holds custodial parents accountable and ensures shared parenting can be pursued amicably.
The well-being and holistic development of children depend heavily on the presence and involvement of both parents. I urge the Maryland State Legislature to amend existing child support laws to include these provisions. Such changes will not only rightfully align legal and custodial responsibilities but also protect the child's best interests.
