Require Charities to Have Known the Deceased to Contest a Will
The Issue
Following the passing of my Aunt in 2021, three well known charities whom she never had any relationship with, have been laying claims to her entire estate. This situation not only disrespects her expressed wishes to leave only small tokens to these organisations but also inflicts significant emotional and financial hardship on our family. We find ourselves unable to properly grieve and lay our loved one to rest due to the persistent caveat they have placed on her estate. Furthermore, the ongoing legal battles to defend her last wishes are financially debilitating.
Unfortunately, our situation is far from unique. It appears that the current system enables charities to relentlessly contest wills, irrespective of their relationships with the deceased. This can result in lengthy, distressing, and costly legal process for families who are already dealing with the loss of a loved one.
To effect change in this deeply flawed system, we are asking for a requirement to be put in place, ensuring that only charities that have had a meaningful relationship with the deceased can contest a will. This will discourage the unwarranted aggressive legal actions by such organisations and uphold the last wishes of our departed loved ones.
If it was your loved one that had died, and a faceless charity and solicitor started adding caveats to your loved ones last wishes, you will not be able to administer the estate and it will cost you thousands to prove your loved ones last wishes.
Now imagine at christmas you lose a beloved Aunt, a week later you lose your Mother, and in the new year you are contacted by Solicitors from the Charities contesting your Aunts will, and stopping you from laying them to rest properly. That's my families reality right now, my 84 year old Father who lost his beloved wife of over 58 years, and sister is now a wreck and cannot move on because Charities that had no knowledge of my Aunts existence before her death, are now saying they are entitled to more of her estate.
