REQUEST UEM FOR RECTIFICATION OF MAILBOX DESIGN AT ASPIRA PARKHOMES

The Issue

We hope this letter finds you well. We are writing to bring to your attention an issue regarding the mailbox condition in Aspira Parkhomes. It has come to our attention that the current design and dimensions of the mailboxes do not meet their intended purpose. Specifically, the mailboxes were constructed with a depth exceeding 104 cm and a width of only 18.5 cm,making it impractical for residents to collect their mail effectively. We emailed to developer on 21 December 2023 to request the as-built drawing and mailbox specification but until the date of the letter, we haven’t received any reply from your side. We received petitions from Parkhomes residents who have shared their thoughts on the mailbox condition. As the developer of the property, we respectfully request your attention and action to address this matter. It is of utmost importance to provide a functional and practical mailbox system that caters to the needs of our residents. We propose that the developer consider adjusting the dimensions of the mailboxes to meet the standard dimensions recommended for easy access and retrieval of mail. We understand that rectifying this issue may require time and resources, but we firmly believe 
that it is essential for the overall satisfaction and convenience of our residents. We kindly request your consideration of this matter, as it directly affects the daily lives of our residents. 
We are open to discussing and collaborating with the developer to find a suitable solution that resolves this matter smoothly.
We refer to clause 25 (1) in the Housing Development (Control and Licensing) Act, [Act 118]; we have the right to claim from the developers to rectify any defect quoted under,
“25. (1) Apa-apa kecacatan, pengecilan atau kekurangan lain pada Bangunan tersebut yang menjadi ketara kepada Pembeli dalam tempoh dua puluh empat (24) bulan kalendar selepas tarikh Pembeli mengambil pemilikan kosong Bangunan tersebut dan yang disebabkan oleh kecacatan Kemahiran kerja atau bahan-bahan atau; Bangunan 
tersebut tidak dibina mengikut pelan-pelan dan perihalan sebagaimana yang dinyatakan dalam Jadual Kedua dan Keempat sebagaimana yang diluluskan atau dipinda oleh Pihak Berkuasa Yang Berkenaan, hendaklah diperbaiki dan diperbetulkan oleh Penjual dengan kos dan perbelanjaannya sendiri dalam tempoh tiga puluh (30) hari dari tarikh Penjual menerima notis bertulis mengenainya daripada Pembeli.”
We look forward to hearing from you without delay. If we do not receive a satisfactory reply within seven (7) days from the date of the letter, we will proceed to take all necessary action against you including publishing to the Media and claiming from the Strata Management Tribunal.
If the developer fails to do so, we will proceed to engage a third-party vendor to carry out the rectification works and back-charge your company for all the costs incurred. Thank you for your attention to this matter. We appreciate your cooperation and look forward to a swift resolution.
