Request for Independent Review of Custody Authority in Clark County Case Involving Erich M

Request for Independent Review of Custody Authority in Clark County Case Involving Erich M
The Issue
Petition To
- Nevada Attorney General
- Governor of Nevada
- Nevada Department of Corrections
- Clark County District Attorney
We respectfully request an independent review of the legal basis for the continued incarceration of Erich Milton Nowsch in the State of Nevada.
Court records from Clark County Justice Court dated March 2015 reflect dismissals and case-closure language for serious charges initially filed in this matter, including documentation indicating the case was closed and related proceedings canceled. Subsequent filings, including notices from the Nevada Supreme Court and an active habeas corpus proceeding, raise unresolved questions regarding case identity, jurisdiction, and the authority under which continued custody is being maintained.
This petition does not seek to relitigate guilt or innocence, nor does it accuse any individual or institution of misconduct. It asks only that appropriate state authorities conduct a transparent review to determine whether current incarceration is supported by a valid judgment of conviction and lawful commitment order.
Due process and clarity in the exercise of custodial authority are foundational to public trust in the justice system. When official court records appear to conflict with ongoing custody, an independent review is warranted in the interest of transparency, accountability, and confidence in the rule of law.
We respectfully request that the Attorney General, Governor, or appropriate oversight authority review the available court records and publicly clarify whether the continued incarceration in this matter is legally supported.
Evidence
A compiled packet of court records (2015–2025), including Justice Court minutes, custody status documentation, Supreme Court notices, and habeas filings, is available here:

Why This Matters
This petition is about procedural clarity and lawful authority, not emotion or public pressure. When court records raise legitimate questions, an independent review protects both individual rights and the integrity of the justice system.
