Request for Change, Preserve Your Constitutional Rights.
The Issue
I extend my greetings to the general public, and thank you for legitimately taking the time to read this message; I do not have a lot of influence. I am originally from Vermont. I am an American citizen, like many others, who is disgruntled. Disgruntled by and towards the United States government. It is time for action to be taken. Action that will create positive change. Action that will protect our (as in the American people) rights and freedoms.
I am writing this message for multiple reasons. These reasons include but are not limited to, fear, frustration, stress, and to some extent even anger.I firmly and strongly believe that this message not only needs to be read, but comprehended and heard as well. I am an average American citizen, with an average lifestyle, who like many, if not most, American citizens, are not in any way shape or form satisfied, happy, or content with the current state of the political climate. I believe, and strongly hope that many American citizens will follow and support the message I have to state.
Firstly, I must notate, that I am neither left or right; neither conservative or liberal, and neither republican or democrat. I firmly believe that the constitution of the United States, especially the first ten amendments (the Bill of Rights) are the absolute and ultimate form of law and order of the United States. As such, it should not be challenged in any way shape or form, by any level of government, whether it be local, state, or federal. I do not understand how the general government body, who are supposed to be limited in power over the governed, are constantly getting away with infringing on most, if not all, constitutional rights. Rights we the people, have natural rights to exercise in any location, any time, at any level we decide.
In addition, people have been getting harrassed, attacked, and in some cases even arrested for speaking their minds. This is a violation of the first amendment. Not only is this disheartening for the general public, but there seems to be added salt to the wound. This is including the fact that some states are trying to pass “language laws” and putting an absolute violation to our constitutional right to freedom of speech. Even in social media such as Facebook, Tiktok, Instagram etc. there has been extreme censorship on any form of speech or expression that does not fit the political narrative of the management of said media platform. This especially is infuriating because in 1997, the supreme court ruled in Reno Vs. ACLU that the internet is to be treated as a free speech zone.
it is unconstitutional for New York, Massachusetts, California and any other state that follows suit, to have any form of gun control. I especially do not understand this when it has been proven time and time again that the vast majority of gun violence in the United States occurs in gun free zones. Especially including the fact that up to 60% of gun crime is perpetrated by persons who have obtained a firearm illegally. Additionally, it is also statistically proven that anywhere between five-hundred thousand, and three million lives are saved each year, with defensive gun violence. It is also of grave importance that I mention that the vast majority of gun violence is committed with a handgun, not an “assault weapon”, a handgun. Handguns specifically, as of a 2019 study, shows that 45.7% of all homicides were committed by a handgun. It is estimated from said study, that less than 7% of gun related homicides were committed with “assault weapons.” The leftover amount of homicides were committed by non-firearm methods such as, poison, drug overdose, explosions, blunt objects, hands and feet, or knives and other cutting instruments.
As far as the third amendment, I can not speak on any violations; the most recent example of a violation would be 1965. I am only assuming this is because certain parts of the government have not had the opportunity. Moving forward to the fourth amendment, it has been documented that, Immigration and Customs Enforcement (ICE) have been impersonating regular police officers and using other methods of deception to gain warrantless access to individuals homes for years. Not only have they used deception, but they have also used fear and intimidation tactics to instill confusion and disarray among the immigrant communities; ICE has also encouraged mistrust towards legitimate police officers.
Sixty years of precedence, protecting the fifth amendment (Miranda Vs. Arizona), where it was required to inform any person(s) being taken into custody, that they have the right to remain silent and a right to an attorney, is now issued immunity. This new supreme court ruling in Vega Vs. Tekoh allows law enforcement officers who violate the fifth amendment, to do so without consequence. Any self incriminating information given without the Miranda warning, can also be admissible in court, when it did not occur in the past. Officers who violate the fifth amendment should be held accountable. Person(s) who are not given the Miranda warning should not be prosecuted for anything they say as well.
There is no doubt that former President Donald J. Trump is a controversial and colorful character. Despite how anyone, including myself, feels towards Trump, he, like any other American citizen, has the same constitutional rights. As such, in one of the many indictments that have been put forth regarding Trump, it has been revealed that New York County District Attorney Alvin Bragg, has willfully refused to disclose any information pertaining to the alleged crime. This is an obvious and blatant violation of the 6th amendment as it is clearly stated in the 6th amendment. “"be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have a compulsory process for obtaining witnesses in his favor.”
When it comes to civil cases and suits regarding common law, there has been a study that shows federal lawsuits decided by jury have dropped from 5.5% in 1962 to 0.8% in 2013. The leading cause for this is mainly due to the fact that judges have taken it upon themselves to oversee the majority of lawsuits and civil cases. Judges have also decided to give themselves the power to overrule a jury’s verdict. If a jury is present for a case, whether it be criminal or civil, the jury’s verdict should always be the final verdict. The judge should not have the power to overrule anything a jury decides, in any case, as it goes against the entirety of both the 6th and 7th amendments.
An entire correctional facility has been ruled to violate the eighth amendment rights for hundreds of inmates. The entire facility was deemed to have conditions so severe that not only did it violate the eighth amendment, it also violated the Americans with Disabilities Act. Conditions were so poor that hundreds of inmates were housed in solitary confinement without reason. Some Inmates residing at David Wade Correctional Center were stripped of all personal belongings, including clothes. To make matters worse, they were also deprived completely of having any social interactions with other people for indefinite periods of time. This is an abhorrent example of cruel and unusual punishment - an obvious violation of the eighth amendment.
In terms of the ninth amendment, I would not be able to document an example of a violation; I would not be able to do so, because it is vague, vague by design. However, the ninth amendment has been paired in rulings with other amendment violations for added severity. The tenth amendment however, is my main focus of this message. It is my main focus because it seems to be the amendment the general legislative body has forgotten or lost its meaning; a meaning which I will detail further.
There are more examples of amendment violations I could give, but I feel listing an example of the most important ones (The Bill of Rights) should be the main focus. Further reasons the general American public and myself are frustrated, scared and angered for and with the United States government, is the fact the United States government is no longer fulfilling its duty to serve the people. That is the original duty of any government position - the people come first. However, the majority is more concerned with pushing their own individual agenda, lining their own pockets, or just just filling a spot while not accomplishing anything. I strongly feel that the general public of the United States, and myself, are frustrated immensely by the fact that the vast majority of the government is leaving the average American citizen to be extremely underrepresented.
Furthermore, I do not understand how we, as a nation, have gotten to the point where slander, hate and propaganda is considered the standard for a government official to use as tools for fueling their candidacy/campaign. We, as a nation, are supposed to be better than and above that uncivilized nonsense. Proper candidacy and campaigning is supposed to be purely based on what it is you are trying to accomplish, and how you plan to accomplish it, and let the people (us) decide who we think is the better option. This is, of course, without propaganda influence - and I mean that for both sides. CNN needs to stop with the left wing/democratic propaganda as well as Fox needing to stop their right wing/republican propaganda.
The division between political parties is only a thing of recent years. There used to be a time where the differences of political beliefs were used by mature adults. Used in a fashion where they used said beliefs to compliment each other. Left wing is rooting for progression, believing everything needs to change in order to move forward. The right wing believes everything is fine the way it is and there's no need to change anything. The two sides of the political climate, at one point, accomplished amazing and beautiful things with compromisations. The right wing was able to show the left wing where progression is viable, and where it's outlandish. The left wing was able to show the right wing, where in some areas, progression is necessary. We have moved so far from that point of legislation, that every government official is so unwilling to make compromises, that everything has either become so left wing, that left wing states are absolutely failing economically; or, so right wing, that it's almost as if they are stuck in the World War II era. As former President Lincoln once said “a house divided, can not stand”.
With this said, as one part of this message, I humbly request that we do everything within our power and ability, to make change, abide by the constitution, come together, make compromises, and meet in the middle. Do not just try to pass a bill that is radically left, or radically right, just to spite the other side. Actually use intelligent conversation and discuss where progress is appropriate, and where it is not.
In relation, I know for a fact, that a lot of the general government is under the impression that we, american citizens (the people they are under obligation, and under oath i might add, to serve and represent) are not intelligent enough or aware enough to see what some individuals or groups within the government, is trying to accomplish. I must announce that the vast majority of us are very aware, and are honestly, to some extent, scared. We the people understand that “gun control” is not about protecting people from gun violence. We the people know that is just propaganda that some parts of the government body is spoon feeding the people. They are spreading this propaganda to make what is really occurring sound appealing. We the people, understand that this, is in fact, the first phase of trying to accomplish a total authoritarian state, or dictatorship. This is the first phase of our government, as we know it, attempting to become tyrannical. There is no society or nation in all of history, where disarming the citizens did not result in tyrannical rule. As Thomas Jefferson once said, “when tyranny becomes law, rebellion becomes order.”
We the people are also aware that phase two is already occurring - digitizing all forms of financial ownership. This is going to escalate to the point where some of the government officials can and will have absolute control over any citizen's personal, hard-earned money. We the people are also aware that the government is attempting to do so, so that they can, at any point in time, cease our finances. The general government body is trying to acquire this tool to control/manipulate us into submission under tyranny. We the people know this, because there are already businesses, and government organizations that refuse to take cash. It is also safe to assume that at some point, if not already, someone will attempt to pass a bill that bans the usage of paper cash and metal alloy coins.
The general American public is vastly more intelligent, and aware than the general government body assumes us to be. I honestly fear for the American future if the government continues down this dangerous road. It is supposed to be, “we the people, by the people, for the people ''. In no sense whatsoever, is the United States government supposed to be superior to its citizens, you are public officials, whose duty it is to serve the people, not the other way around.
I am not here to complain about the grievances a large portion of the general American public share for the sake of complaining. I am sharing these grievances to raise awareness. I also have a few solutions to offer. I must admit, these solutions in which I implore the legislation and the government as a whole to implement (for the general happiness of the American people) are not solutions the legislation or the government will find satisfactory to them. However, as i forementioned, the government's purpose is to serve the people, in such a way, that ensures their happiness and content.
The first solution I strongly encourage the legislative body to implement, is to ratify a 28th amendment. This amendment is something that I do not believe should even be required. In contrast, with the current state of the political climate, it is a must. As we all know, for any bill or law to be passed, it must be a majority vote; which, for the most part, I believe is good. However, in regards to the potential 28th amendment, it should have a statement that makes it an undeniable and unchallengeable standard. A standard that puts forth a requirement for all bills, laws and regulations that affect the original ten amendments (or The Bill of Rights) to cast not a majority vote, but a unanimous vote; if something regarding the first ten amendments is important enough to be changed, then all members of the legislation will agree to pass it.
Secondly, I offer an additional solution to encourage consistent ambition towards the growth of the nation. Too many members of legislation are extremely past the age of retirement for most citizens. For the happiness and content of the people, I firmly express the need for term limits on congress and the house of representatives. Not only will it encourage consistent ambition towards growth, but it would also deter the chance of any lingering influence of corruption. It is blatant hypocrisy for the presidency and vice presidency to have term limits, but not the legislation. A Legislation in which arguably has more power and authority than the presidency and vice presidency. Senators and Representatives alike should be held to the same, if not, higher standard than the presidency and vice presidency.
Finally, I also, for the protection of not only the constitution; but for the protection of our general american lifestyle, along with our liberty, is to ratify a 29th amendment. I will admit the wording of this amendment would have to be carefully placed. Placed in a way where it does not infringe on aforementioned amendments. This amendment would be put in place to not prohibit the expression for it, not to prohibit the conversation about it, and not to prohibit it on small scale practice. The sole purpose would be to prohibit the practice of communism, Marxism, fascism, or any other form of governing methods that challenge democracy in the United States government. A prohibited practice in all levels of government whether it be federal, state, or local. To challenge the democracy our founding fathers fought with extreme persistence and hardship to build and keep, is quite frankly, one of the most disrespectful things you can do to American culture and history.
I am almost certain of the possibility that none of the solutions I am offering will be successful. With that said, I still feel the need to at the very least, put forth these solutions. Solutions that I can almost guarantee, would protect all the rights, amendments of the constitution and general happiness, content, and liberty of the people.
The American people need to see this change be executed. If the requested change is not put in place, then I shall petition to have our current government replaced. If the government of the United States does not implement the needed change, I shall petition with a secondary message. A Message that contains a replacement plan for our current government, which is within our rights as the people. Rights that is listed in the Declaration of Independence. Alongside this replacement plan, will be a peaceful request for the current government to step down. The current government structure will also be declared as null, void, and ineffective as the governing authority.
Thank you for taking the time to genuinely read this message, and I sincerely hope to see positive change come from it.
