According to a report by the National Human Rights Commission, 92% of trans people in India are subjected to economic exclusion, with access to education and employment being major areas of concern. The bill fails to provide comprehensive anti-discrimination measures that could combat these stark inequalities.
The bill also lacks provisions for affirmative action, which could help improve access to education and employment opportunities for transgender individuals. Without targeted initiatives that actively promote the inclusion of trans people in social and economic spheres, the community remains marginalized and vulnerable.
In addition to these shortcomings, the bill imposes lower penalties for crimes such as sexual and physical violence against transgender individuals, compared to those imposed for similar crimes against cisgender people.
