Repeal the Sedition Act 1948
The Issue
The Sedition Act 1948, a piece of old legislation enacted before Malaysia's Independence, is a gross violation of freedom of speech and expression in a democratic society. The Act disproportionately penalises dissenting voices, fostering a culture of fear and suppressing democratic debate. Under this Act, anyone attempting to do an act of 'seditious tendency' can be sentenced to 3 years in prison, fined with RM5,000 or both. The problem here is that 'seditious tendency' is loosely defined, with the terms 'hatred' and 'disaffection' disturbingly vague and overly broad. This paves the way for misuse and violation of individual rights.
In 2024, Malaysia’s placing on the World Press Freedom Index sits at the 73rd place - a steep decline from last year, 107th place. We are the 2nd worst ranked country in ASEAN, which leads to heavy concern. It's time to reevaluate this Act that has been criticised for violating the freedom of speech protected under Article 10(1) of the Federal Constitution.
