Petition for the Removal of Waynesboro Officials for Obstruction, Concealment, and Misconduct in Office
We, the undersigned, call for the immediate investigation and removal from office of the following officials:

Nicole Briggs, Clerk of the Waynesboro Circuit Court
David Ledbetter, Commonwealth’s Attorney for Waynesboro
William Flory, Assistant Commonwealth’s Attorney for Waynesboro
 
Background
The people of Waynesboro deserve a justice system rooted in transparency and honesty. Evidence now indicates a coordinated effort within the Waynesboro Circuit Court and Commonwealth’s Attorney’s Office to conceal court records, obstruct access to evidence, and suppress proof of judicial misconduct.

I, Julian Keith Tracey-Rucker, have repeatedly requested access to official transcripts and records from my criminal case—documents that contain what I have come to call the “Doomsday Transcripts.” These transcripts record proceedings that expose procedural fraud, falsified probation reports, and judicial misconduct.

Despite multiple lawful requests submitted on July 26, 2025, Clerk Nicole Briggs falsely stated that no transcripts exist because no appeal was filed. This claim is legally incorrect under Va. Code § 17.1-213, which guarantees public access to recorded proceedings at any time.

Further evidence includes:

A recorded conversation with Detective Jessie Shaver discussing who altered and forged documents tied to my trial.
Emails from  VADOC employee Melodie Harris, confirming she did not authorize or make the handwritten “write-in” change that appears on official court records.
Court filings and correspondence to the Clerk’s Office and Commonwealth’s Attorney’s Office that remain ignored or suppressed.
These actions collectively reveal a pattern of concealment, falsification, and obstruction that undermines public confidence in Waynesboro’s justice system.

 
Legal and Ethical Concerns
The conduct of these officials appears to violate several laws, including:

Obstruction of Justice – Va. Code § 18.2-460
Concealment or Falsification of Public Records – Va. Code § 18.2-472
Malfeasance and Neglect of Duty – Va. Code § 24.2-233
Deprivation of Rights Under Color of Law – 18 U.S.C. § 242
Obstruction of Federal Proceedings – 18 U.S.C. § 1519
By knowingly concealing evidence and denying access to official court records, these officers have obstructed justice and violated their oaths of office.

What We Demand
We, the undersigned citizens, demand the following:

Immediate suspension and investigation of Nicole Briggs, David Ledbetter, and William Flory.
Public release of all court audio recordings and unaltered documents for cases CR19000532-00 and CR20000077-00.
Referral of evidence to the Virginia State Police Bureau of Criminal Investigation and the U.S. Department of Justice Civil Rights Division.
Initiation of formal removal proceedings under Va. Code § 24.2-233 for malfeasance, neglect of duty, and misuse of office.
 
Why It Matters
The courts belong to the people—not to those who abuse them.
When public officials falsify or conceal evidence, they undermine not only one case but the entire foundation of justice.

Transparency, accountability, and truth are not optional—they are the bare minimum we expect from our public institutions.

We, the citizens of Waynesboro and Virginia, demand accountability, the restoration of integrity within the courts, and the removal of officials who have betrayed their oath and our trust.
