The Issue

Our world changed forever on December 22 when we lost our oldest son. After numerous complaints of signs and symptoms indicative of a massive pulmonary embolism, his cries for help went unheeded by his doctor. Just three days after his last visit to the doctor’s office, he succumbed to the very condition he'd been desperately trying to communicate. His death was not just a personal tragedy for our family, but a glaring reminder of the systemic issues that plague Texas's medical malpractice laws, specifically House Bill 4 enacted in 2003.

House Bill 4 places a cap on non-economic damages in malpractice lawsuits, making it exceedingly difficult for victims and their families to seek fair recourse when medical professionals fail in their duty of care. This arbitrary limitation not only undermines the value of a human life but also shields negligent practitioners from accountability.

By removing this cap, we can pave the way for fair trials and just compensation for those affected by medical negligence. Medical professionals must be held accountable when their actions, or lack thereof, lead to unnecessary suffering or loss of life.

The current law limits the compensation for pain, suffering, and emotional distress, factors that are often the most devastating element of malpractice. This financial bar is unconscionably low and fails to reflect the true impact of medical errors on families who have already suffered the ultimate loss.

Replacing House Bill 4 will not only provide justice to families like ours but will also serve as a deterrent against future negligence. It will encourage diligence and care among medical providers, ensuring better patient outcomes and safer medical practices across Texas.
