The Issue
In Del Norte County, California, our local government made a significant decision without giving residents a chance to voice their opinions. Automatic License Plate Reader (ALPR) technologies, including those provided by Flock Safety, were implemented without any public comments or hearings. According to the California Civil Code § 1798.90.55, agencies must ensure public oversight and accountability when deploying new surveillance technologies. This code exists to protect our privacy rights and ensure our voices are heard, yet it's being ignored. Additionally, the Brown Act emphasizes the importance of open meetings for government officials where public participation is encouraged. Unfortunately, these protocols were seemingly bypassed in this decision-making process.
Beyond the legal oversight, there is the looming threat of major cybersecurity vulnerabilities. ALPR systems store a vast amount of sensitive data, which if accessed unlawfully, can lead to unwanted surveillance and hacking. The potential for abuse and cyber attacks puts every resident's private information at risk, causing alarm among those who value their privacy and security.
The absence of a privacy portal exacerbates these concerns, leaving citizens in the dark with no mechanism to monitor how their data is used or to whom it is disclosed. In a digital age, where personal information can be so easily exploited, it is critical to establish and maintain proper protections and transparency.
I urge the Del Norte County authorities to take immediate action by removing Flock Safety and similar ALPR technologies until public hearings can be held and proper regulatory and security measures put in place. We need to prioritize our community’s voice and protect our rights from potential overreach.
