Regulate Will Writing and Ensure Independence of Executors

The Issue

Following the deeply personal and heart-wrenching experience following my late father's death, it has been brought to my attention the serious need for reform in the regulation of will writing and the independence of executors. My father's will was altered under dubious circumstances before his demise, leaving me excluded due to external influences, and the will was not executed correctly. The profound grief of his loss was aggravated by the injustice and hardship that followed.

By current UK law, will writing is an unregulated market, despite the serious repercussions that can occur from inadequately written or manipulated wills (Citizens Advice Bureau). This lack of oversight allows unqualified individuals to draft vital legal documents and offers no protection to grieving families. Executors, entrusted with the management of the estate, can also be potentially influenced by various interests, leading to further potential for abuse and mismanagement.

The impact is not only emotional but also financial. According to Direct Line Life Insurance, as much as £576 million is lost each year in the UK as a result of poorly written or wrongly managed wills. Left unaddressed, these problems can divide families, foster mistrust, and tarnish memories.

We are therefore, requesting a change in legislation to regulate the writing of wills and enforce the independence of executors, as the current system provides ample scope for prejudices, conflicts of interest, and misconduct. It is essential to protect the rights of beneficiaries and ensure that the final wishes of the departed are honored with respect, justice, and integrity.
