Subject: Request to register FIR, arrest and remand Sri Vara Prasad Nagularapu @ Hamara Prasad for circulating social-media posts announcing a book titled “False Leader Dr Ambedkar / Kalpitha Nayakudu (The Fabricated Leader)”, thereby promoting enmity, public mischief and insult calculated to disturb public order; request to consider preventive detention in view of criminal antecedents; and request for independent investigation into persons instigating him.
Respected Sir/Madam,
I, the undersigned complainant, most respectfully submit this written information under Section 173 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) for registration of a First Information Report, as the facts disclose cognizable offences.
1. Accused
Sri Vara Prasad Nagularapu, popularly known as Hamara Prasad, social media handle @HamaraPrasad, founder of an outfit styled Rashtriya Dalita Sena, contact numbers and emails publicly used by him, including +91 9177777148 and hamaraprasad1@gmail.com, website hamaraprasad.in. Exact present residential address may be ascertained by investigation. He has previously been dealt with by Hyderabad City Cyber Crime Police.
2. Facts constituting the offence
Dr Bhimrao Ramji Ambedkar is the principal architect of the Constitution of India, a Bharat Ratna, and a national symbol of equality, fraternity and the rule of law. Large sections of citizens, including Scheduled Castes, treat his memory and writings with reverence.
The accused is publicly propagating, on Facebook and other platforms, that he will publish/has finalised a book titled in substance “False Leader Dr Ambedkar” / “Kalpitha Nayakudu” / “The Fabricated Leader”, and is soliciting circulation of that title and related content, including posts dated on or about 20 August 2026 thanking persons who supplied the phrases “The Fabricated Leader” and “ఆబద్ధపు పునాదులపై నిర్మించబడిన నాయకుడు” and asking that the material be widely shared.
Calling the Father of the Indian Constitution a “fabricated / imaginary/false leader” is not academic criticism. It is a calculated public imputation intended to lower him in the estimation of the public, to wound the dignity of communities that identify with him, and to provoke confrontation. When such content is pushed on social media for mass circulation, it is reasonably likely to cause fear, alarm, caste polarisation and breach of public tranquillity.
3. Criminal antecedents (same pattern of conduct)
In February 2023, Hyderabad City Cyber Crime Police arrested the same accused after a viral video in which he used grossly abusive language against Dr Ambedkar and stated that he would have shot Ambedkar as Godse shot Gandhi. FIR No. 256/2023 was registered under Sections 153-A and 505(2) of the Indian Penal Code. He was arrested and remanded. Despite that prosecution, he has resumed a campaign of the same character. Recidivism after remand shows that ordinary prosecution has not deterred him and that the present campaign is wilful.
4. Legal provisions attracted (prima facie)
The information discloses, among others, the following cognizable offences. Final sections are to be applied after investigation.
Provision Substance
BNS Section 196 (old IPC 153-A) Promoting or attempting to promote disharmony, enmity, hatred or ill-will between groups on grounds of caste or community, including by electronic communication.
BNS Section 197 Imputations and assertions prejudicial to national integration.
BNS Section 353 (old IPC 505) Making, publishing or circulating statements, rumours or reports, including by electronic means, with intent to cause, or which are likely to cause, fear or alarm to the public or any section thereof whereby any person may be induced to commit an offence against public tranquillity, or to incite one class/community against another.
BNS Section 352 (old IPC 504) Intentional insult with intent or knowledge that it is likely to provoke breach of public peace.
BNS Section 356 Defamation by publication of imputations harming reputation, to the extent applicable to the living community and public memory associated with Dr. Ambedkar.
SC/ST (PoA) Act, 1989 — Ss. 3(1)(r) and 3(1)(u) Intentional insult/intimidation with intent to humiliate in public view; and promoting feelings of enmity, hatred or ill-will against members of Scheduled Castes — if investigation establishes the statutory ingredients, including caste of the accused and “public view”.
Information Technology Act, 2000 To the extent electronic records are used to commit the above offences. Investigation may consider relevant provisions other than the struck-down Section 66-A.
Duty to register FIR: Where information discloses a cognizable offence, registration of FIR is mandatory (Lalita Kumari v. Government of Uttar Pradesh, (2014) 2 SCC 1; BNSS Section 173). A preliminary enquiry, if any, cannot be used to refuse registration when the ingredients above are disclosed on the face of the posts.
Arrest and remand: The offences under BNS 196 and 353 are cognizable. Given antecedents, likelihood of repetition, and the need to collect electronic evidence and prevent further circulation, the investigating officer may arrest in accordance with BNSS Sections 35–187. Remand may be sought for custodial interrogation limited to what is necessary for the recovery of devices, the identification of collaborators, and the prevention of further posts.
5. Request to consider the Telangana Prevention of Dangerous Activities Act, 1986
The Telangana Prevention of Dangerous Activities of Bootleggers, Dacoits, Drug-Offenders, Goondas, Immoral Traffic Offenders, Land-Grabbers, Cyber Crime Offenders and White Collar or Financial Offenders Act, 1986 (PD Act) permits detention where the competent authority is satisfied that a person falling within a defined class is acting in a manner prejudicial to maintenance of public order.
Public order under Section 2(a) and the Explanation is deemed affected if activities cause or are calculated to cause harm, danger or alarm or a feeling of insecurity among the general public or any section thereof.
Grounds urged for consideration for PD Act (not as a substitute for FIR):
The accused is a repeat offender on the same subject-matter (abuse of Dr Ambedkar on social media) after arrest and remand in FIR 256/2023.
The present campaign is not a one-off remark; it is organised publicity for a book whose very title brands a constitutional icon as “fabricated”, aimed at mass electronic circulation.
Such content has, in the past, produced public outrage, political agitation, and a live law-and-order and public-order situation in Hyderabad. Recurrence is reasonably apprehended.
If investigation shows he falls within the statutory class of “goonda” and/or “cyber-crime offender” as defined in the PD Act, and that ordinary criminal process is insufficient to prevent further prejudice to public order, the Commissioner of Police / District Collector may independently examine a proposal under Section 3 of the PD Act.
I am aware that the Hon’ble Supreme Court has repeatedly held that preventive detention cannot be used as a substitute for ordinary criminal law or for a mere “law and order” problem, and that the authority must record subjective satisfaction with material showing public order, not apprehension alone. The request is that the competent authority apply that test to the present facts, including antecedents and the ongoing campaign.
6. Investigation into persons behind the accused
The accused’s own post acknowledges that others supplied the title phrases and that he wants the material shared especially with a targeted audience. This indicates instigation, funding, content support or organised amplification.
It is therefore requested that the investigation be independent and impartial, and that:
electronic trails (handles, payments, printers, publishers, page admins, WhatsApp/Telegram groups) be collected under BNSS and the IT Act;
persons who commissioned, financed, drafted, printed or systematically amplified the “Kalpitha Nayakudu / Fabricated Leader” campaign be identified; and
the same penal provisions be invoked against them if evidence discloses conspiracy, abetment or common intention (BNS Sections 45–62 as applicable).
7. Prayer
It is therefore prayed that the Station House Officer may be pleased to:
1. Register an FIR forthwith on this information under the appropriate sections of the BNS, the SC/ST (PoA) Act and the IT Act;
2. Seize and preserve the social-media posts, devices and publication material;
3. Arrest the accused in accordance with law and produce him before the competent Magistrate for remand if custodial interrogation is necessary;
4. Place a speaking proposal, if satisfied on material, before the Commissioner of Police / District Magistrate for consideration of action under the Telangana PD Act, 1986;
5. Investigate the network of persons behind the accused and proceed against them under the same laws; and
This complaint is made in good faith for maintenance of public order and the dignity of the Constitution and its architect.
