Regain Kentucky Waterway Access Rights

The Issue

Growing up, I spent countless hours exploring the creeks and streams of Kentucky. These waterways were more than just bodies of water—they were the foundation of my childhood adventures, a place where I first learned to fish, splashed away the summer heat, and connected with cousins and siblings. However, that freedom and joy of exploring the natural world are under threat. Now, as my niece is old enough to embark on similar adventures, she faces restrictions and limitations that we never imagined. Accessing these public waters has become a legal issue, and something as innocent as playing in a creek could be deemed trespassing.

In Kentucky, the waters of our creeks, streams, and rivers are a public resource, intended for the enjoyment and benefit of all citizens. Historically, these waterways up to the high water mark were accessible for boating, fishing, swimming, and travelling. Unfortunately, changes in legal interpretations and property rights have restricted this access, infringing upon our rights as citizens and denying us the experiences many of us cherish. The current restrictions not only impact recreational activities but also diminish our cultural heritage, severing the connection with nature that is integral to Kentuckians.

This petition seeks to restore our rightful access to the public waterways of Kentucky, up to the high water mark. By advocating for legislation that reaffirms our rights, we can ensure these waters remain open and accessible for all. Restoring access will promote outdoor recreation, support local economies dependent on tourism and fishing, and foster a deep respect for our environment, while keeping property owners safe from trespassers with improved codes for beyond the high water mark. 

Together, we can reclaim the opportunities we had growing up and preserve them for future generations. It is imperative that we act now, to prevent further loss of access to these essential natural resources.

Join me in urging Kentucky lawmakers to take action to allow access on our public waterways, as we have a citizen’s right to.
