The Issue

We, the undersigned citizens of Jamaica, respectfully submit this petition to address significant concerns regarding the implementation, interpretation, and enforcement of the Road Traffic Act 2023. Our aim is to propose reforms that align with the Jamaican Constitution, particularly under Section 13 which guarantees the right to fair treatment, and Section 16 which ensures protection from arbitrary deprivation of property, including fines.

    Conduct a comprehensive review of the penalty structure to ensure fines are proportionate to the offense, promoting safety while respecting the principles of fairness and justice as outlined in the Constitution.
  • Training and Standardization for Law Enforcement:
    Implement mandatory periodic training and assessment for all traffic enforcement officers, overseen by an independent legal committee, focusing on the correct interpretation and application of the Act. Establish clear guidelines for what constitutes a valid traffic offense. This can be especially valuable for officers who wish to advance their careers or pivot as such.
  • Clarification of Legal Language:
    Revise the Act to incorporate precise legal language to prevent misinterpretation. Define explicitly what actions constitute improper vehicle control, distinguishing between minor distractions and significant safety hazards.
  • Public Consultation and Feedback Mechanism:
    Establish a formal channel for public consultation on the Act's enforcement. Create a system where citizens can submit feedback or complaints regarding enforcement practices, ensuring transparency and accountability.
  • Digital System Transparency and Improvement:
    Overhaul the digital ticketing platform to enhance transparency, centralization, accuracy, and user-friendliness. Ensure clear instructions for contesting tickets, accurate record-keeping, and efficient dispute resolution mechanisms.
  • Regular Audits and Oversight:
    Mandate regular audits of traffic enforcement activities and systems to prevent abuse of power. An independent oversight body should be established to monitor enforcement practices, ensuring they align with constitutional rights and public interest.
