Reform Section 302 Mental Health Procedures to Preserve Individual Rights

The Issue

I am a resident of Centre County, PA, and I have personally experienced the impact of Section 302 involuntary commitments. After losing my father to suicide, I was involuntarily committed five times under this section. These experiences did not resolve my mental health issues; instead, they limited my future options by stripping away my rights.

Section 302 is a part of Pennsylvania's Mental Health Procedures Act that allows for an individual to be involuntarily committed for emergency mental health examination and treatment if they are deemed a severe danger to themselves or others. However, one consequence of this process is the permanent loss of certain rights - including the right to own firearms and enlist in the military.

While it is crucial that we protect society from potential harm, it is equally important that we respect individual rights and provide effective mental health support. The current approach can exacerbate feelings of helplessness among those struggling with their mental health - as it did in my case.

We propose reforming Section 302 procedures so that individuals' rights are not permanently stripped away but temporarily suspended until they receive adequate help and demonstrate no longer being a danger to themselves or others. This change will ensure that people who experience involuntary commitments under Section 302 can regain their full citizenry after recovery.
