Reform Pet Custody Laws to Prioritise Animal Wellbeing
The Issue
I am a pet owner who is experiencing firsthand heartbreak and confusion that comes from navigating pet custody after a separation. My partner and I shared a dog, in addition to the one I brought into our relationship. Our dogs formed an inseparable bond, playing together and even curling up together for comfort. However, when we separated, it was decided that our shared dog would stay with me since my parents didn't have any other pets. His parents did and our dog is scared of unknown dogs.
Now, my ex-partner wants more access to our shared dog despite not contributing financially or practically to her care. Not putting her first when he’s introducing her to other pets and young children. Also this means separating my two dogs as he won’t be seeing the eldest dog despite knowing her for 7 years, he’s never asked about either of them, this causing more upset for both dogs, when the youngest dog isn’t around the eldest dog seems lost and doesn’t know where to go or what to do. This situation has highlighted the inadequacies of current pet custody laws which often consider only who initially paid for the animal rather than what is in the best interest of the pet.
Pets are family members too and their wellbeing should be paramount in any legal decisions made about their care. Current laws do not require full disclosure on where they live, how their wellbeing is cared for, if the person is at work all day, who pays for their upkeep or what conditions they live under - this needs to change.
According to research by Animal Legal & Historical Center (2018), pets are still considered property under law in many jurisdictions worldwide which can lead to unfair outcomes during separations or divorces.
We need legislation that recognises pets as sentient beings with rights and needs beyond being mere property. We need laws that ensure all relevant information is provided so informed decisions can be made about their welfare post-separation.
