Reform Laws Regarding Non-Custodial Parental Rights and Litigation Abuse

The Issue

I am a custodial parent of two children, living in Bronx, NY. My personal experience has led me to witness the flaws in our current legal system regarding non-custodial parental rights. The non-custodial parent of my children has repeatedly used the court system to secure visitation rights but does not exercise these rights, causing emotional distress for my children and myself.

The non custodial parent involved had visitation and unfortunately during that visitation the non custodial's father had abused my children. The non custodial parent is fully aware of it and still takes me to court for visitation saying it is their right. The non custodial parent only gets one day out of the week, barley comes to the visitation to where I kept a log and the court decided not to accept it. There is a video of my child on social media while during the visitation, my son is being humiliated. It's about time the court revisits these laws in regards to non custodial parent visitation. In respect to those who are involved, active and are a positive role model in their child's life. However it's not right a non custodial parent who does nothing at all still have rights. What about the children's rights? What about custodial parent's rights? Why is it ok to have a non custodial parent who knows nothing about a child be entitled to the right of the child when they dont participate in the childs life or make the childs life harder.

It is unprofessional for a judge, attorney or anyone in the court says to a parent who does everything for a child, "well you chose that person", "You chose him", "you chose her". It shows the person who spent years studying still has no knowledge on their profession. 

The issue extends beyond my family. There are countless custodial parents who struggle with co-parenting due to inconsistent involvement from the non-custodial parent. This inconsistency combined with litigation abuse puts an enormous mental health risk on our children.

This isn't about Mother vs Father. This isn't about Woman vs Man. This about custodial parent vs non custodial parent. There are fathers out there who are custodial parent and they receive the same treat if not worse. Let this petition be the voice that's not being heard.

According to a study published by the American Psychological Association, high-conflict divorce or unwedded situations can lead to negative outcomes for children including depression, anxiety and decreased academic performance (American Psychological Association). Yet our current laws do not adequately protect custodial parents and their children from this type of abuse.

We need reform that takes into account not just the legal rights of parents but also considers the psychological well-being of our children. We ask lawmakers in Bronx, NY and across America to review existing laws related to non-custodial parental rights and litigation abuse. We seek changes that protect custodial parents from unnecessary legal battles while ensuring that visitation rights are granted based on consistent involvement in a child's life rather than mere entitlement.
