Reform Joint Enterprise Law to Allow for Appeals and Fairer Sentencing
The Issue
I am writing this petition out of personal pain and a deep sense of injustice. I have lost loved ones due to the current joint enterprise law, a law that seems more punitive than just. The joint enterprise law allows for individuals to be convicted for crimes they did not personally commit, but were merely associated with in some way. This broad interpretation has led to countless people being unfairly sentenced.
The major issue with this law is the lack of significant contribution part. It means that someone can be convicted under this law without having played a substantial role in the crime committed. This is not justice; it's an abuse of power.
Moreover, those convicted under joint enterprise currently have no right to appeal their sentences, further compounding the injustice they face. According to data from The Bureau of Investigative Journalism, between 2005 and 2013 there were at least 1,853 people prosecuted under joint enterprise laws in England and Wales alone (source: The Bureau of Investigative Journalism).
We are calling on lawmakers to reform the joint enterprise law so that it requires proof of significant contribution before conviction can occur. Additionally, we demand that those previously convicted under this unjust interpretation be given the right to appeal their sentences.
This change would ensure fairer treatment for all involved and would prevent future miscarriages of justice like those my loved ones experienced.
