The Issue
I am a resident of Indiana, and my life has been deeply affected by the current "No Fault Law." My wife had an affair with her boss for over 1.5 years before I discovered it. During this time, I was diagnosed with congestive heart failure, with my heart functioning at only 30% capacity when the affair started. There were three instances where she took our children out of state, leaving me alone at home while my oxygen level was dangerously low - only 70%, when anything under 90% necessitates hospitalization.
Under the current law in Indiana, marital misconduct such as adultery does not affect property division during divorce proceedings. This means that despite her actions causing significant emotional and physical distress to me, she is still entitled to half of our marital assets.
This is not just about me; it's about all Hoosiers who have suffered due to their spouse's infidelity or other forms of marital misconduct. According to a study by the Institute for Family Studies (IFS), approximately 19% of men and 16% women in America have cheated on their spouses.
It's time we change this law in Indiana so that it takes into account cases like mine where one party has caused significant harm through their actions within the marriage. The pain caused by infidelity should be considered during divorce proceedings and asset division.
