Recycle or Release: Holding Companies Accountable for Packaging Waste

The Issue

Petition Summary:
Everywhere you look—whether it’s food brands, clothing companies, tech gadgets, or anything else—businesses use packaging with their logos and designs. They lock it down with copyrights and patents so no one else can use the same thing. But here’s the problem: most of that packaging ends up in landfills, oceans, and streets instead of being recycled.

Here’s what I’m asking for:

  • If a company wants to protect their packaging design, they need to recycle 100% of the packaging they produce.
  • If they can’t do that, then they shouldn’t be allowed to stop others from reusing similar designs.

This applies to ALL companies—food, fashion, electronics, beauty brands, and more. If they’re creating waste, they need to take responsibility or let others make use of it instead.

 
Why This Matters:

  • Massive Waste: Millions of branded boxes, wrappers, bags, and tags end up as trash every day.
  • Environmental Impact: Companies contribute to pollution while protecting their packaging designs.
  • Fairer Use: If they’re not recycling it, why stop others from using it?
     

Legal Perspective: Why Trash Should Void Packaging Rights:
There’s a long-standing legal principle: once an object is discarded into the trash, it becomes public property. This is why anyone can rummage through garbage legally, and why law enforcement can collect evidence from your trash without a warrant.

By placing branded packaging in the waste stream, companies are essentially relinquishing control over these materials. If the intention is for the packaging to be thrown away, it’s clear that they are voiding their copyright and patent rights on some level. Here’s why:

  • No Reasonable Expectation of Control: When companies knowingly design packaging to end up in the trash, they abandon any realistic claim to maintain exclusive ownership.
  • Public Domain by Action: Once discarded, the material enters public spaces (landfills, streets, oceans) where anyone could theoretically use, mimic, or repurpose the design.
  • Consistency with Consumer Behavior: Companies cannot claim the exclusive right to control packaging that is explicitly intended for disposal, as doing so contradicts their own actions.


To preserve their copyrights and patents, companies must show responsible stewardship by ensuring their packaging is recycled, not discarded. This would demonstrate a clear intent to retain ownership, consistent with copyright law principles.

This petition isn’t just about accountability—it’s also about giving companies a way to retain control. If they switch to 100% recycled materials for their packaging, they will:
