The Issue
The decriminalisation of adultery in India, as a result of the 2018 Supreme Court judgment in Joseph Shine v. Union of India, has left many families vulnerable and struggling. This ruling struck down Section 497 of the Indian Penal Code (IPC), a provision that once held accountable those who chose to engage in adulterous relationships, thus damaging the sanctity of marriage and family. While this decision intended to uphold personal freedoms, its repercussions have rippled through numerous households, destabilising family structures, and affecting the psychological well-being of our children.
Families are the cornerstone of our society, providing stability, nurturing, and an environment where children can thrive. The dismantling of Section 497 has inadvertently weakened these foundations, leading to more instances of infidelity that go unpunished. This lack of legal consequence for those who transgress the sacred bonds of marriage undermines family unity and emboldens those who would act without regard for the emotional damage inflicted.
A family torn apart by adultery faces profound challenges: emotional trauma, financial instability, and an uncertain future for children caught in the crossfire. These children, who are innocent bystanders, often bear the brunt of marital discord, affecting their mental health and developmental milestones. Why should we let our legal system fail these families by neglecting to address the root cause of their suffering? The legal framework must reflect our society's values, which prioritize the family as a fundamental unit and protect its integrity and sanctity.
Therefore, by reinstating legal consequences for adultery involving a male person with someone's wife, we seek to re-establish the equilibrium necessary for healthy familial relationships. Such legislation would serve as a deterrent, dissuading individuals from engaging in illicit affairs that tear families apart. Although modern society calls for personal freedoms, these should not come at the cost of infringing on the rights of families to remain unified and strong.
I urge the Supreme Court of India to reconsider its stance and criminalise adultery once again.
