The Issue
My beloved three-year-old Rottweiler, Sakari, nearly died due to severe post-operative negligence. After a routine spay, her incision began actively bleeding. I brought her back to the clinic (Vista Vet Animal Hospital & Pet Lodge in Round Rock, TX), but she was sent home despite my concerns. The following day, her intestines fell out of the surgical site. It was the fast action of the Round Rock Fire Department that rushed her to an emergency veterinary hospital where surgeons managed to save her life.
Despite Sakari’s miraculous survival, the legal system regarded what happened to her as merely a property issue, completely disregarding her suffering and the negligence she endured. Texas law currently treats companion animals as property instead of the sentient beings they truly are. This loophole allows extreme negligence to go unpunished and offers little to no justice for the victims and their owners.
Animals are sentient, capable of feeling joy, pain, loneliness, and companionship. They enrich our lives in innumerable ways, and it's time the law recognizes their intrinsic value beyond that of property. The current legal framework fails to provide adequate recourse for negligent actions that can severely harm or even end the lives of our beloved pets.
In states like Oregon and Illinois, laws recognizing animals as sentient beings have resulted in stricter penalties for animal cruelty and negligence. These laws offer a model for how we can reform Texas statutes. By acknowledging the emotional and social worth of animals, courts can hand down just penalties that reflect the seriousness of the crime.
Let's call for legislative changes that reflect scientific understandings of animal sentience and acknowledge the important role pets have in our lives. We need comprehensive legal protections that ensure their safety and well-being. From stricter regulations in veterinary practices to stronger penalties for negligence, Texas must lead by example.
