The Issue
Update:
Worse, the management company (Intempus Management) is now aggressively threatening unit owners with collection actions – including extra fees, interest, and legal proceedings – simply for refusing to pay unfair and disputed assessments. On December 19, Assistant Property Manager Jorge Adrian sent emails stating delinquent accounts are being "forwarded to collections." This targets owners fighting assessments that violate our CC&Rs by unfairly undercharging large tenants.
We can't let the HOA and management defy the city's order or intimidate owners standing up for fairness! Our vital community hub in Little Saigon is at stake.

Dear Mayor Matt Mahan, San Jose Police Department (SJPD), Department of Transportation (DOT), and Code Enforcement,
Vietnam Town in San Jose's Little Saigon is under siege from HOA mismanagement and predatory towing, threatening this vital Vietnamese community hub. We demand immediate city action to investigate and resolve these issues.
The Crisis:
The 550-space parking garage has been blocked for years due to unresolved construction defects, including faulty elevators with incorrect flooring. This closure violates city permits requiring adequate parking for commercial operations, creating chaos and enabling illegal towing.
Predatory practices by Morris & Son Towing include towing vehicles in loading zone over 30 minutes (e.g., a July 27, 2024 invoice for a loading zone tow charging $480), violating California Vehicle Code §22953, which mandates a one-hour wait on free public-access private property.
Devastating Impact:
Thousands of customer vehicles towed in last 4 years, causing financial strain and deterring visits—foot traffic has plummeted, slashing business revenue by up to 45%. Our Demands:
- Launch an SJPD/DOT investigation into Morris & Son Towing: Audit logs, HOA contracts, and VEH §22953 compliance; impose fines, revoke permits, and order restitution for victims.
- Compensation will be provided to car owners whose vehicles were towed unnecessarily.
- Force HOA to reopen the full garage with city oversight, ensuring permit compliance and defect repairs.
- Hold a public hearing and enact protections like grace periods and signage.
