Pour la restauration et la protection de l’accès public au littoral, à la plage et à la mer dans la région de Balaclava / Pointe aux Piments

Nous, soussignés, résidents de Balaclava, Pointe aux Piments, Arsenal, Triolet, Plaine des Papayes, Terre Rouge et des villages avoisinants, ainsi que citoyens concernés, usagers du littoral, pêcheurs, familles et organisations de la société civile, souhaitons attirer votre attention sur la situation préoccupante de l’accès public au littoral, à la plage et à la mer dans la région de Balaclava / Pointe aux Piments.

Nous remercions l'Honorable Ministre du Logement et des Terres pour avoir indiqué au Cabinet, le 29 mai 2026, qu’il considérait la re-proclamation de la plage publique connue comme « Pointe aux Piments (Pointe Oberoi) – Portion 1 », dé-proclamée en 2008.

Toutefois, au-delà de cette portion spécifique, nous souhaitons souligner un problème plus large : l’accès réel, sûr, pratique, visible et permanent des citoyens au littoral dans cette région.

Les plages, lagons, baies et rivages de Maurice constituent un bien commun. Ils font partie de notre identité nationale, de notre culture, de nos loisirs, du bien-être des familles et des moyens de subsistance de nombreuses communautés côtières.

Or, dans la région de Balaclava / Pointe aux Piments, l’occupation progressive du littoral par des développements hôteliers et privés a fortement réduit l’accès effectif des habitants à la mer. Entre l’InterContinental Resort Mauritius et l’hôtel Le Méridien, il existe environ 4,29 km de littoral, alors que l’accès public à la plage ne représenterait qu’environ 236 mètres, répartis sur seulement deux emplacements :

1) Pointe aux Piments (Pointe Oberoi) – Portion 1 ;
2) Pointe aux Piments, entre Le Méridien et Victoria Hotels – Portion 2.

Cette situation crée un déséquilibre manifeste entre l’occupation privée de terres côtières de l’État et le droit légitime des citoyens d’accéder à leur littoral. Dans la pratique, les habitants disposent de très peu de points d’accès à la mer, souvent insuffisamment aménagés, peu visibles, mal indiqués ou difficilement praticables.

Notre démarche n’est pas dirigée contre le tourisme ni contre les hôtels de la région. Nous reconnaissons l’importance du tourisme pour l’économie nationale. Cependant, un développement touristique durable doit préserver l’accès des citoyens à la mer, aux plages, aux baies et au littoral.

Par la présente pétition, nous demandons au Ministre du Logement et des Terres et au Gouvernement de Maurice de :

1) Confirmer l’état d’avancement de la re-proclamation de Pointe aux Piments (Pointe Oberoi) – Portion 1 comme plage publique ;

2) Clarifier le statut de la portion dé-proclamée sous GN 958 de 2010, située à Pointe aux Piments, entre Le Méridien et Victoria Hotels – Portion 2, re-proclamer cette portion comme plage publique si le projet de Marine Centre n’est plus d’actualité ou n’est plus une priorité ;

3) Examiner et restaurer un accès public sûr, pratique, visible et permanent à Balaclava Bay, notamment l’accès qui semble avoir été inclus dans le bail de 2010 accordé à  Island Resort Ltd ;

4) Clarifier le statut des terres de l’État situées entre les hôtels Maritim et Westin et évaluer leur proclamation comme plage publique.

5) Identifier toute mesure permettant d’augmenter l’accès public au littoral dans la région de Balaclava / Pointe aux Piments ;

6) Garantir que tout accès public existant, historique ou administratif à la mer soit protégé, signalé, entretenu et rendu effectivement praticable ;

7) Nous demandons que les terres côtières de l’État soient gérées dans l’intérêt général et que le principe d’accès public au littoral soit pleinement respecté.

8) Nous demandons que les citoyens, familles, pêcheurs, jeunes et générations futures puissent continuer à accéder à la mer, à la plage et au littoral, qui font partie du patrimoine commun de la République de Maurice.

CITIZENS’ PETITION

For the restoration and protection of public access to the coastline, the beach and the sea in the Balaclava / Pointe aux Piments region

and to the Government of the Republic of Mauritius

Hon Members of Government,

We, the undersigned, residents of Balaclava, Pointe aux Piments, Arsenal, Triolet, Plaine des Papayes, Terre Rouge and neighbouring villages, together with concerned citizens, coastal users, fishers, families and civil society organisations, wish to draw your attention to the worrying situation regarding public access to the coastline, the beach and the sea in the Balaclava / Pointe aux Piments region.

We thank the Hon Minister of Housing and Lands for having indicated to Cabinet, on 29 May 2026, that he was considering the re-proclamation of the public beach known as “Pointe aux Piments (Pointe Oberoi) – Portion 1”, which was de-proclaimed in 2008.

However, beyond this specific portion, we wish to highlight a broader issue: citizens’ real, safe, practical, visible and permanent access to the coastline in this region.

Mauritius’ beaches, lagoons, bays and shores are a common good. They form part of our national identity, our culture, our leisure, the well-being of families and the livelihoods of many coastal communities.

Yet, in the Balaclava / Pointe aux Piments region, the progressive occupation of the coastline by hotel and private developments has greatly reduced residents’ effective access to the sea. Between the InterContinental Resort Mauritius and Le Méridien hotel, there are approximately 4.29 km of coastline, while public access to the beach appears to represent only about 236 metres, spread across only two locations:

1) Pointe aux Piments (Pointe Oberoi) – Portion 1;
2) Pointe aux Piments, between Le Méridien and Victoria Hotels – Portion 2.

This situation creates a clear imbalance between the private occupation of State coastal lands and the legitimate right of citizens to access their coastline. In practice, residents have very few access points to the sea, often insufficiently developed, poorly visible, poorly signposted or difficult to use.

Our approach is not directed against tourism or against the hotels in the region. We recognise the importance of tourism to the national economy. However, sustainable tourism development must preserve citizens’ access to the sea, beaches, bays and coastline.

Through this petition, we request the Minister of Housing and Lands and the Government of Mauritius to:

1) Confirm the progress made regarding the re-proclamation of Pointe aux Piments (Pointe Oberoi) – Portion 1 as a public beach;

2) Clarify the status of the portion de-proclaimed under GN 958 of 2010, situated at Pointe aux Piments, between Le Méridien and Victoria Hotels – Portion 2, and re-proclaim this portion as a public beach if the Marine Centre project is no longer current or is no longer a priority;

3) Examine and restore safe, practical, visible and permanent public access to Balaclava Bay, particularly the access which appears to have been included in the 2010 lease granted to Island Resort Ltd;

4) Clarify the status of the State lands situated between the Maritim and Westin hotels and assess their proclamation as a public beach;

5) Identify any measure that would increase public access to the coastline in the Balaclava / Pointe aux Piments region;

6) Guarantee that any existing, historical or administrative public access to the sea is protected, signposted, maintained and made effectively usable;

7) Ensure that State coastal lands are managed in the public interest and that the principle of public access to the coastline is fully respected;

8) Ensure that citizens, families, fishers, young people and future generations can continue to access the sea, the beach and the coastline, which form part of the common heritage of the Republic of Mauritius.
