The Issue

For many Indigenous American families, including my own, the Indian Child Welfare Act (ICWA) is a crucial pillar in our lives. It's heartbreaking and infuriating to witness yet another attempt by the government to dismantle this fundamental law. Our brothers, sisters, their children, aunts, uncles, nieces, nephews, and countless others are at risk if we don't take a stand. We must protect the remnants of Indigenous American culture and community. Join me in this fight, as we stand united to protect our birthright and our future.

The ICWA was established in 1978 in response to the alarming rates at which Native American children were being removed from their homes and placed in non-Native environments, often resulting in the loss of cultural identity and heritage. According to the National Indian Child Welfare Association, before the enactment of ICWA, 25% to 35% of all Native children were removed from their homes; of these, 85% were placed outside their families and communities, even when fit relatives were willing to raise them.

This Act safeguards the interests of Native children and their families by giving Tribal governments a strong voice in child custody proceedings. It prioritizes keeping Native children with their families and communities, thus preserving their cultural connections and identity. The United States Supreme Court is currently reviewing the constitutionality of ICWA, which poses a direct threat to thousands of Native children and the preservation of tribal sovereignty.

Raising awareness about the importance of ICWA and the positive impact it has on preserving Native American culture is crucial. Repealing or weakening ICWA would not only disrupt Indian families but also jeopardize the perseverance of Tribal heritage, community stability, and children's well-being. Tribal sovereignty, recognized in numerous treaties and upheld in U.S. law, is at risk.

Action is needed to ensure that this vital law remains intact and that its protections continue to serve Native communities. By supporting and standing with Native communities, we send a clear message: Indigenous rights are non-negotiable, and tribal sovereignty must be respected and upheld.
