

As this petition approaches 500 signatures, I want to clarify the spirit of this effort. This is not about being “anti-development” or “anti-housing.” Miami Beach can support housing while also protecting its historic identity. Both goals should coexist through clear, lawful, and consistently applied rules.
The current situation shows how difficult this balance has become. The City has attempted to assert historic protections, while legal conflicts with developers have emerged around how the Live Local Act is applied. This legal uncertainty places residents, historic districts, and the City itself in a difficult position.
The real issue is not choosing between housing and preservation. The issue is the lack of clarity and stability in how rules are interpreted and enforced. Clear, transparent, and consistently applied standards would reduce litigation and better protect historic districts without undermining legitimate housing goals.
At the state level, there has already been work to strengthen historic protections. For example, Florida State Representative Fabien Basabe has filed legislation such as HB 717 (2025) to strengthen penalties for unlawful demolition of National Register contributing buildings. This shows that protecting historic heritage and respecting the rule of law can go hand in hand.
As a next step, I have a scheduled meeting with a Miami Beach Commissioner on March 12 to discuss the impact of the Live Local Act on historic districts and to explore constructive policy solutions that respect both housing needs and historic preservation.
