Protect Ontario Property Owners from Unfair Archaeological Costs

The Issue


We, Dee and Jay Kettle, are calling on the Government of Ontario to review and amend current regulations that place the full financial burden of mandatory archaeological assessments on private property owners.

In June 2023, we purchased a 70 acre property with a dream to build a peaceful spa and retreat that would support our livelihood, our future, and contribute to our local community.

 

Our vision included:

 

*A small, nature-based spa
*Two guest accommodations
*Low-impact use of the land
*A space focused on wellness, relaxation, and respect for nature


However, in our development proposal, we were required to relocate our septic system. In the summer of 2025, we were informed that a mandatory archaeological assessment must be completed.

 

This process:

 

*Is fully paid for by the homeowner
*Has no clear cost limit
*Has no defined timeline
*Can delay or stop projects indefinitely


As homeowners, we were not made aware of these potential obligations at the time of purchase.

 

We now face:

 

*Significant and unknown financial costs
*Project delays with no clear end
*Emotional stress and sleepless nights
*Uncertainty about our future and retirement


We respect and support the importance of preserving history and Indigenous heritage. However, the responsibility for these investigations should not fall entirely on private homeowners.

This is not a fair or sustainable system.

 

 
We are asking the Government of Ontario to:


*Provide financial support or cost-sharing for mandatory archaeological assessments
*Set clear limits on timelines and costs
*Increase transparency for buyers before property purchase
*Ensure fairness between public interest and private responsibility
 

 
This is about fairness, transparency, and protecting everyday Ontarians.

No homeowner should be placed in financial uncertainty for fulfilling regulatory requirements that serve the broader public good.

We ask for change, not just for us, but for every current and future property owner in Ontario.
