Protect NHS Non-Clinical Staff from Unfair Visa Salary Rules
The Issue
The Issue
Non-clinical NHS staff employed under Agenda for Change (AfC), a Nationally agreed pay scale by Government are at risk of losing their right to work in the UK due to Skilled Worker visa salary thresholds that do not align with nationally agreed NHS pay structures.
We urge the UK Government to urgently review these thresholds and introduce AfC-specific exemptions or transitional protections for long-serving NHS non-clinical staff.
Why This Matters
The NHS relies on non-clinical professionals — including HR, finance, IT, administrative and operational staff — to function safely and effectively. Many have dedicated 3–4 years or more to the NHS, choosing public service over higher-paid private sector roles.
Recent increases to Skilled Worker salary thresholds (£41,700 or £31,300) mean many AfC roles, particularly Band 4 and Band 5, can no longer meet visa requirements — even at the top of their pay bands. NHS trusts cannot simply raise salaries, as AfC pay is nationally negotiated.
This risks forcing experienced, skilled staff out of the NHS not because of performance or progression, but due to structural pay constraints beyond their control.
What We’re Calling For
The Government should:
* Adjust or exempt Skilled Worker salary thresholds for NHS non-clinical AfC roles
* Provide long-term transitional protection for staff sponsored before April 2024
* Recognise non-clinical NHS roles as essential public service occupations
* Base immigration decisions on service, contribution and progression — not a rigid salary figure
* Work with NHS Employers and unions to protect workforce retention

A fair immigration framework that values public service, protects NHS workforce stability, and ensures non-clinical staff are not forced to leave the UK due to incompatible pay structures.
