

Recent developments indicate that the Social Democrats have joined calls to include transitional provisions in the forthcoming citizenship legislation.
This is a critical issue of legal certainty, fairness, and proportionality.
Individuals who have lawfully resided in Sweden for years, built private and family life, participated in the labour market, paid taxes, and applied for, or become eligible for, citizenship under the current legal framework, have thereby acquired legitimate expectations that their applications will be assessed in accordance with the rules in force at the relevant time.
To impose stricter requirements retroactively would:
• undermine legal predictability
• violate principles of good administration
• create disproportionate hardship
• risk breaching protections under Article 8 of the European Convention on Human Rights, particularly where individuals have deep-rooted ties to Sweden
Transitional rules are therefore not a political concession, they are a legal necessity.
We call on lawmakers to ensure that the final legislation includes clear and robust transitional provisions safeguarding those already within the system.
Failure to do so would erode trust in the rule of law and penalize individuals who have acted in full compliance with existing requirements.
