The Issue

This deeply personal and pressing matter stems from my troubling experience of having my employer, without my consent or knowledge, engaging in invasive searches of my digital persona. As an employee, we should have the freedom to express ourselves online, even create petitions, without facing detrimental consequences, unless our posts pose a direct threat to others. Our privacy and freedom to express our thoughts should be shielded by the 1st amendment.

There have been numerous cases wherein employees have been wrongly penalized for their online activities outside of work. It's disconcerting that our employers could be judging, writing us up, or even firing us based on something we posted on our personal social media accounts. This violates not only our right to free expression but also our privacy.

A comprehensive law at the Senate is needed—one that strictly prohibits employers from using our social media behavior against us. Our freedom to speak openly about our views should remain untouched. Legal repercussions should exist for employers who cross this boundary. The monitoring of employees should be limited to on-the-clock behaviour, their customer service, and their contributions to the workplace.

Moreover, social media screening by employers could also potentially foster discriminatory practices. According to a CareerBuilder survey, 70% of employers use social media to screen candidates before hiring, and 48% use it for checking on current employees. Such practices provide them an unfair basis to make decisions not relevant to an employee's performance.

Let's build, together, a safer, more private digital universe for working individuals. This is not a fight for employees alone; it is also a struggle for freedom, privacy, and respect. Let's remind the Senate that our social media accounts are ours, not our employer's business.
