Protect Consumer Freedom: Stop Unconstitutional Bans on Kratom

The Issue

A Petition to: Federal and State Lawmakers, Regulatory Agencies, and Public Health Officials Across the United States, lawmakers and regulatory bodies have increasingly moved to ban kratom — a plant that many Americans use responsibly for personal wellness. These bans are often enacted with little transparency, minimal public input, and without clear scientific consensus supporting prohibition. For many citizens, these actions represent more than a policy disagreement. They represent a troubling erosion of individual freedom. The United States was founded on principles of personal liberty and limited government. Adults have long been trusted to make informed decisions about what they choose to consume — whether that involves caffeine, alcohol, supplements, or herbal products. When government authorities impose sweeping bans on naturally occurring plants like kratom without robust evidence of widespread public harm, it raises serious constitutional and ethical concerns. Just today I was notified through my google notifications that a governor in my state imposed a ban on kratom. My city did not adhere to this, my community was not informed and we were certainly not given an opportunity to take part in this decision that affects many of us directly, and affects all of us by once again removing our rights from decisions made about how we can live as Americans. This governor should be stripped of any political authority immediately. I will not name this person because that;s not what this petition about. It is about the fact that this has become a commonly ACCEPTED practice in our country. I am essentially writing the same petition as I have before; to send to different people and try to drive the point home to everyone I possibly can - That this method of action is in every aspect unconstitutional. It is a direct attack on our freedoms as Americans. This is a public stance AGAINST the rights and freedoms of the American people. It is not about kratom necessarily or this politician particularly but the fact that this is happening more and more and it should have never been accepted to begin with and if I need a million signatures and a Supreme Court justice to read this for it to stop - then that is what I will do because I cannot just stand by and watch my country rot at the hands of people like this. Kratom has been used for centuries in traditional cultures. Today, millions of Americans report using it responsibly for wellness, focus, and relief from discomfort. Yet rather than pursuing reasonable regulation that protects consumer safety and product quality, some jurisdictions have chosen outright prohibition. Any business that is practicing safe and responsible methods would happily accept responsible regulation and even vote to approve it; because it would remove a lot of the negative stigmas that have been placed on us by others who took advantage of this lack of regulation. THAT would show concern for the health and safety of the American people. Not unconstitutional prohibition enforced with only fear mongering, supported by no scientific evidence. This approach creates several serious problems: - It removes personal choice from law-abiding adults. - It drives products into unregulated underground markets, where safety standards disappear. - It ignores growing scientific research and real-world consumer experiences. - It establishes a dangerous precedent for banning other natural products without due process. Americans deserve policies grounded in transparency, science, and constitutional respect for individual autonomy. Instead of bans, lawmakers should pursue responsible frameworks such as: - Age restrictions and responsible sales standards - Product testing and labeling requirements - Quality control regulations for manufacturers - Consumer protection laws to ensure purity and accurate dosing These approaches protect public health without stripping citizens of their freedom to make personal decisions. We are calling on lawmakers and regulators to: 1. Halt attempts to ban kratom at the state and federal level. 2. Support evidence-based regulation rather than prohibition. 3. Protect the rights of Americans to access natural botanical products responsibly. 4. Ensure future regulatory decisions include public input and transparent scientific review. Freedom means trusting informed adults to make choices about their own bodies. Prohibition without due process undermines that principle.
