However, the framework currently lacks comprehensive safeguards for applicants who are seeking information against someone in the very institution expected to protect them—the police force.

My own experience of using Clare’s Law highlighted the vulnerability of applicants when the subject is a serving police officer. The potential for bias, fear of retribution, or conflicts of interest present significant barriers to a fair and impartial process. How can applicants trust they will receive the unbiased information they need, free from interference or intimidation?

Statistics show that trust in the police, particularly in cases involving disciplinary actions against officers, is wavering. According to a report by the Independent Office for Police Conduct (IOPC), there is a concerning number of complaints regarding the mishandling of cases involving police officers. Such statistics fortify the need for reformed protocols and procedures when Clare's Law requests involve serving police officers.

To address this, I propose the following actionable changes:

1. Establishing an independent body responsible for handling Clare’s Law applications where the subject is a serving police officer. This would eliminate any potential conflict of interest and ensure a transparent process.

2. Introducing mandatory training for officers involved in the Clare’s Law disclosure process, focusing on impartiality and sensitivity to the unique challenges faced by applicants.

3. Developing a confidential reporting mechanism for applicants to voice concerns without fear of reprisal, ensuring their safety and fostering a trusting environment.

4. Implementing regular audits of the Clare’s Law process to monitor effectiveness and identify areas for improvement, especially in cases involving police officers.
