Prohibit the Release of Balloons in Asbury

The Issue

As a surfer and fisherman in Asbury, I have a deep connection to our local marine environment. However, it breaks my heart to encounter dead marine life tangled and choked on balloons and other debris that cruelly end their lives. 

Balloons may seem innocent, but their consequences are anything but light-hearted. They cause severe harm to our marine life when they float into their habitats and are mistaken for food. This problem is more widespread than you might think and poses a severe threat to our marine ecosystems. 

My town of Asbury park has always been influential amongst neighboring communities. Our actions echo in our vicinity, and by banning the release of balloons in our town, we can set an example for others to follow. A change like this could save countless marine lives and protect the beauty of our oceanic ecosystem for future generations. 

The timeliness of this petition is paramount. As the Fall is a time of migration, our shore lines are loaded with bio diversity ranging from whales, dolphins and tuna to everything in between.  Every balloon released is a potential death sentence for our marine friends. Let's elevate Asbury as a beacon of sustainability and marine protection.

To the Petition Supporters, The City has already adopted and passed an Ordinance concerning this. Further detail can be found below: City of Asbury Park, NJ § 28-5. INTENTIONAL RELEASE OF BALLOONS. § 28-5.1. Purpose. [Ord. No. 2018-34 § 28-4.1] It is hereby found and declared that it will be the public policy of City of Asbury Park to take action when feasible to reduce the effects of certain products utilized, placed, or released with the environment in order to protect the health and safety of the general public. § 28-5.2. Release of balloons. [Ord. No. 2018-34 § 28-4.2] This section is adopted in order to protect the environment, particularly the wildlife, and the health, safety and well-being of persons and property by prohibiting the release of helium balloons into the atmosphere, including latex and mylar, as it has been determined that the release of balloons inflated with lighter-than-air gases pose a danger and nuisance to the environment, particularly to wildlife and marine animals so as to constitute a public nuisance and may pose a threat to the safety of its inhabitants and their property. § 28-5.3. Prohibited releases. [Ord. No. 2018-34 § 28-4.3] It shall be unlawful for any person, firm or corporation to intentionally release, organize the release, or intentionally cause to be released balloons inflated with a gas that is lighter than air within the City of Asbury Park limits, except for: 1. Balloon released by a person on behalf of a governmental agency or pursuant to a governmental contract for scientific or meteorological purposes. 2. Hot air balloons that are recovered after launching. 3. Balloons released indoors. § 28-5.4. Violations and penalties. [Ord. No. 2018-34 § 28-4.4] Any person found in violation is guilty of a non-criminal infraction punishable by a fine not to exceed the sum of five hundred ($500.00) dollars.
