Pressure on Scott Morrison to act is building and speculation has been growing this week that Porter will not return from leave to the Attorney General role. This would be an important step toward victory, as we have argued it is untenable for Porter to remain the nation’s first law officer while such a dark cloud hangs over his head. PM BACKS AWAY FROM PORTER - 25/3/21
After originally insisting that Attorney General Christian Porter had his full support, Prime Minister Scott Morrison this week began hinting that Porter will not be continuing as Attorney General when he returns from medical leave.
Two weeks ago a journalist asked the PM “Is it tenable for Christian Porter to continue as the attorney general…? And will you consider moving him to a different position in cabinet as something of a circuit breaker…?’
Morrison replied at the time “No, I wouldn’t consider moving to someone else. He’s a fine attorney general and a fine minister for industrial relations, and he is an innocent man under our law…”
That unequivocal response was starkly different to a response he gave this week at a media conference on Tuesday, to a question on whether his thinking on Porter and his fitness to remain in the Ministry had changed in light of recent events.
Morrison replied “I have been getting advice from the solicitor general. I have received that advice and are now taking advice through the Department about how that sits with ministerial standards and I will be making further decisions on that matter…”
And in Parliament yesterday the PM dropped further hints that Porter’s days as Attorney General were numbered, stating “I am considering that advice from my department secretary … in terms of the application against the ministerial guidelines and when I have concluded that assessment … I’ll make a determination and I’ll make an announcement at that time.”
Meanwhile media speculation is rife that Porter will be stripped of the Attorney General portfolio but stay in Cabinet as Minister for Industrial Relations.
While shifting Porter to a different Cabinet role addresses the most pressing and serious conflicts of interest that would arise were Porter to remain Attorney General while suing the ABC for defamation, it does not address the question of whether Porter is a fit and proper person to remain in the Ministry.
